Accordingly, in the draft Decree of the Government regulating the organization of public service units, the Ministry of Home Affairs proposes (at Point a, Clause 1, Article 7) that public service units that self-insure regular and investment expenditures must establish a Management Board to decide on important issues of the unit (except for educational institutions that have established School Councils and University Councils according to the provisions of specialized law);
Based on specific conditions, management requirements and regulations of specialized laws, if necessary, ministries, ministerial-level agencies, and agencies under the Government (hereinafter referred to as ministries and branches), the Provincial People's Committee shall prescribe the establishment of Management Boards for public service units not specified in Point a, Clause 1, Article 7.
The Management Board is the representative of ministries, ministerial-level agencies, agencies under the Government, and provincial People's Committees at public service units, performing the following tasks and powers:
Decide on the unit's strategy, medium-term and annual plans; decide on investment policies to expand operations, establish, reorganize, and dissolve affiliated units; decide on policies on the organization of the apparatus and personnel (except for the number of employees implemented according to the provisions of the law on civil servants); approve the regulations on functions, tasks, powers and organizational structure (or regulations on organization and operation) of the unit to submit to competent authorities for decision; approve annual financial settlement reports, conduct inspections and supervision of plan implementation, implementation of democratic regulations, and decide on other important issues of the unit according to the provisions of law.
The Management Board has from 5 to 11 members; The Chairman and other members of the Management Board are appointed by the head of the competent authority approving the autonomy Project of the public service unit.
The term of a member of the Board of Directors shall not exceed 5 years. The structure and number of members of the Management Board in public service units under the industry and field shall comply with the provisions of specialized laws and the instructions of the Ministry of Industry and field management.
Representatives of the superior management agency of the public service unit in the Management Council include representatives of ministries, ministerial-level agencies, agencies under the Government, provincial People's Committees and direct superior management agencies (if any).
