On January 7, according to Lao Dong reporter's investigation, the Ministry of Home Affairs is collecting public opinions on the Draft Report to the National Assembly and the draft Law on Government Organization (amended).
The Government's Draft Proposal states that, in order to perfect regulations related to the organization of the Government's apparatus in the direction that the Government takes the initiative in deciding to arrange and perfect the internal organization of ministries and ministerial-level agencies, ensuring streamlining, effective and efficient operations, the draft Law removes the provisions in Article 40 of the current Law on the organizational structure of ministries and ministerial-level agencies.
The Draft Law devotes one chapter to Ministries, ministerial-level agencies and Government agencies.
Accordingly, a Ministry or ministerial-level agency is a Government agency that performs the function of state management of one or several sectors, fields and public services within the sector or field nationwide.
The Government Office is a ministerial-level agency of the Government, an apparatus assisting the Government and the Prime Minister, with the function of providing general advice and assisting the Government and the Prime Minister in performing their duties and powers as prescribed by the Government. The head of the Government Office is the Minister, Head of the Government Office.
The Government specifically prescribes the functions, tasks, powers and organizational structure of each ministry and ministerial-level agency.
Article 18 of the draft Law stipulates the responsibilities of Ministers and Heads of ministerial-level agencies as heads of ministries and ministerial-level agencies.
Accordingly, Ministers and Heads of ministerial-level agencies are personally responsible to the Prime Minister and the Government for the results, effectiveness and efficiency of the operations of their ministries and ministerial-level agencies; for their decisions and the results of their implementation within the scope of their assigned tasks and powers;
Carry out work reports to the Government and Prime Minister; report to the people on important issues under management responsibility.
Article 19 of the draft Law stipulates Deputy Ministers and Deputy Heads of ministerial-level agencies.
Accordingly, Deputy Ministers and Deputy Heads of ministerial-level agencies assist the Minister and Head of ministerial-level agencies in performing tasks assigned by the Minister and Head of ministerial-level agencies and are responsible to the Minister and Head of ministerial-level agencies for the assigned tasks.
The number of Deputy Ministers and Deputy Heads of ministerial-level agencies shall not exceed 5; the Ministry of National Defense, the Ministry of Public Security, and the Ministry of Foreign Affairs shall not exceed 6.
In case of merger of ministries, ministerial-level agencies or request for transfer or rotation of officials by competent agencies, the Prime Minister shall submit to the National Assembly Standing Committee for consideration and decision.
