Mr. Le Van Huy (character's name has been changed) is the Commander of the Commune Military Command, who has been approved by competent authorities to retire from July 1, 2025 according to Decree 178/2024 and Decree 67/2025.
Before retirement, Mr. Huy received a Party Committee member allowance of 0.3; a civil service allowance of 25%; a seniority allowance of 20%; and a position allowance of VND 561,600.
"Are the above allowances calculated when applied according to Decree 178/2024 and Decree 67/2025?" - Mr. Huy wondered.
Regarding Mr. Huy's reflection on the proposal, the Ministry of Home Affairs responded on the Electronic Information Portal.
In Clause 6, Article 5 of Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government (amended and supplemented in Clause 3, Article 1 of Decree No. 67/2025 dated March 15, 2025), Point a, Clause 2, Article 3 of Circular No. 01/2025 dated January 17, 2025 of the Minister of Home Affairs (amended and supplemented in Clause 3, Article 1 of Circular No. 002/2025 dated April 4, 2025) and Point a, Clause 5, Section II of Document No. 1814 dated April 26, 2025 of the Ministry of Home Affairs, stipulate how to determine current monthly salary to calculate the regime and policies prescribed in Decree No. 178/2024; in which, it has clearly determined the allowances that are included in the current month salary to calculate the regime and policies.
Accordingly, party allowances, public service allowances, seniority allowances beyond the framework, seniority allowances, and leadership position allowances are allowances calculated to enjoy the regime and policies according to Decree No. 178/2024.
Pursuant to the provisions of Articles 17 and 19 of Decree No. 178/2024 (amended and supplemented in Clauses 16 and 17, Article 1 of Decree No. 67/2025), the settlement of regimes and policies for subjects is directly managed by the head of the agency, organization, or unit, employing cadres, civil servants, and public employees, and the provincial People's Committee shall consider and decide.
"Accordingly, the determination of allowances to calculate the regime and policies in Decree No. 178/2024 for each case is under the authority and responsibility of the agency directly managing and using cadres, civil servants and public employees" - the Ministry of Home Affairs informed.
Therefore, the Ministry of Home Affairs recommends that you provide information to local competent authorities for guidance and resolution.
