The Ministry of Home Affairs clarifies the authority to appoint and dismiss the position of Deputy Commander of the Commune-level Military Command.

The Ministry of Home Affairs has responded to the authority to dismiss and appoint non-professional workers at the commune level (called Deputy Commander of the Commune-level Military Command).

Accordingly, Law No. 98/2025/QH15 amends and supplements a number of articles of 11 Laws on military and defense, including the Law on Militia and Self-Defense Forces, stipulates the authority of the Chairman of the Provincial People's Committee to decide on the appointment of Deputy Commanders of the Commune-level Military Command; at the same time, stipulates that the above title is a commune-level civil servant.

Therefore, the dismissal of the Deputy Commander of the Commune-level Military Command will be under the authority of the Chairman of the Provincial People's Committee.

In the coming time, the Government will stipulate the job positions for Commanders, Deputy Commanders, and Assistants; the number of Deputy Commanders, Assistants; standards and norms for working equipment of the Commune-level Military Command according to the authority assigned in Law No. 98/2025/QH15 above.

According to Decree 33/2023, the number of non-professional workers at the commune level is calculated according to the type of commune-level administrative unit, specifically as follows: Type I is 14 people; Type II is 12 people; Type III is 10 people.

The title of non-professional activist at the commune level shall be submitted by the Provincial People's Committee to the Provincial People's Council for regulation.

In Hanoi, according to Clause 2, Article 3 of Resolution 18/2023/NQ-HDND, the Hanoi People's Council stipulates the structure of non-professional workers at the commune level, including:

The positions of Head of Commune-level Communication Work, Chairman of the Association of the Elderly; Chairman of the Red Cross Society in communes, wards and towns will be arranged by 1 person.

The positions of Vice President of the Fatherland Front, Vice President of the Veterans Association; Vice President of the Women's Union; Vice President of the Farmers' Association (for communes and wards and towns with the Farmers' Association); Deputy Secretary of the Ho Chi Minh Communist Youth Union: Arrange according to the provisions of the Charter of the Vietnam Fatherland Front; Charter of socio-political organizations and current legal documents.

The Deputy Military Commander arranged the number according to the provisions of the 2019 Law on Militia and Self-Defense Forces and current legal documents.

job title of Party Committee Office: Party Committees of communes, wards and towns under 500 Party members are arranged for 1 person; from 500 to under 1,500 Party members are arranged for no more than 2 people; from 1,500 Party members or more are arranged for no more than 3 people.

Communes, wards and towns arrange titles and the number of titles for non-professional workers at the commune level to ensure that it does not exceed the number assigned annually.
