The Ministry of Home Affairs has just issued Document 5607/BNV-VP in response to the proposal of the Department of Home Affairs of Dak Lak province to guide a number of difficulties and problems in implementing the 2-level local government organization model.
Including content related to the authority to dismiss the Deputy Commander of the Commune-level Military Command and the allowance regime for this position.
Regarding the case of non-professional workers, the Department of Home Affairs of Dak Lak province raised the issue:
First, for the Deputy Commander of the Commune-level Military Command (a part-time worker at the commune level), the Chairman of the People's Committee of the new commune or ward, which authority has the authority to dismiss or is under the authority of which level?
Second, the Deputy Commander is a non-professional activist, if he continues to work until May 31, 2025, will he be entitled to special allowances for national defense and seniority?
Regarding the above contents, the Ministry of Home Affairs has the following opinion: Law No. 98/2025/QH15 amends and supplements a number of articles of 11 Laws on military and defense, including the Law on Militia and Self-Defense, which stipulates the authority of the Chairman of the Provincial People's Committee to decide on the appointment of deputy commanders of the Commune-level Military Command; at the same time, stipulates that the above title is a commune-level civil servant.
Therefore, the dismissal of the Deputy Commander at the commune level will be under the authority of the Chairman of the Provincial People's Committee.
The Ministry of Home Affairs added: In the coming time, the Government will stipulate the job positions for Commanders, Deputy Commanders, and Assistants; the number of Deputy Commanders, Assistants; standards and norms for working equipment of the Commune-level Military Command according to the authority assigned in Law No. 98/2025/QH15 above.
