National Assembly Chairman Tran Thanh Man has just signed to certify Resolution No. 169/2024/QH15 on organizing urban government in Hai Phong city.
With this resolution, the local authorities of Hai Phong City, Thuy Nguyen City, districts, communes and towns in the city still organize both People's Councils and People's Committees.
The Standing Committee of the City People's Council consists of a Chairman, no more than 2 Vice Chairmen and members who are heads of committees of the City People's Council. The Chairman of the City People's Council can be a full-time People's Council delegate, the Vice Chairman of the City People's Council can be a full-time delegate.
When implementing the urban government model, Hai Phong will not organize People's Councils in districts and wards of the city. The local government model in these units only includes People's Committees.
The organizational structure of the District People's Committee includes: Chairman of the District People's Committee; Vice Chairman of the District People's Committee; Chief of the District Police; Commander of the District Military Command; specialized agencies under the District People's Committee; other administrative agencies and public service units under the District People's Committee.
According to the National Assembly's resolution, the People's Committee of a grade I district has no more than 3 vice chairmen; the People's Committee of a grade II and grade III district has no more than 2 vice chairmen.
The District People's Committee operates under the head regime. The Chairman of the District People's Committee appoints, dismisses, transfers, rotates, secondes, rewards, disciplines, and temporarily suspends the work of the Chairmen and Vice Chairmen of the People's Committees of affiliated wards and the heads and deputy heads of specialized agencies under the District People's Committee; recruits, uses, and manages civil servants and public employees under his/her management in accordance with the provisions of law.
The National Assembly Resolution also clearly stipulates the organizational structure, working regime, tasks and powers of the Ward People's Committee; management of cadres and civil servants of communes, wards and towns. Accordingly, the People's Committee of type I and type II wards has no more than 2 vice chairmen; type III wards has 1 vice chairmen.
The Chairman of the Ward People's Committee is the head, directly managing and using civil servants according to Government regulations and decentralization and authorization of the People's Committee at a higher level.
This Resolution takes effect from January 1, 2025. The organization of urban government in Hai Phong city according to the model prescribed in this Resolution shall be implemented from July 1, 2026.
The People's Council and People's Committee of districts and wards for the 2021-2026 term will end their term on June 30, 2026.
From July 1, 2026, the District People's Committee and Ward People's Committee shall perform the tasks and powers as prescribed in this resolution.
In case the Chairman and Vice Chairman of the District or Ward People's Committee have not been appointed, the Chairman and Vice Chairman of the District or Ward People's Committee for the 2021-2026 term shall continue to perform their duties and powers until a new Chairman and Vice Chairman of the District or Ward People's Committee are appointed.
Commune-level cadres and civil servants in Hai Phong city who were elected or recruited before the effective date of this Resolution shall be converted into cadres and civil servants according to the provisions of the Law on Cadres and Civil Servants under the administrative payroll assigned annually to the district level to continue working in their current positions in communes, wards and towns.
In case of transfer to a new job position, it is necessary to ensure standards and conditions according to the provisions of law and in accordance with the job position approved by the competent authority.
