According to information from the Ministry of Home Affairs, the Department of Home Affairs of Dong Nai province recently issued a proposal for guidance on how to determine allowances to calculate allowances and how to determine the time to calculate allowances to reduce staff for non-professional workers.
To promptly pay the regime to part-time workers at the commune level, the Department of Home Affairs of Dong Nai province proposed that the Ministry of Home Affairs guide the application of monthly allowances for part-time workers at the commune level to be implemented with an allowance of 1.5 times the basic salary or an allowance of 2.34 times the basic salary for university level supported by the central budget and local allowance funds (according to Decree No. 33/2023/ND-CP).
In addition, the Department of Home Affairs of Dong Nai province proposed to clarify whether the working time with compulsory social insurance payment in other job positions other than those of the Party, State, socio-political organizations and armed forces is included in the time to calculate the allowance for staff reduction or not?
Responding to the above content, the Ministry of Home Affairs said that Decree No. 154/2025/ND-CP5 stipulates that the current monthly allowance for part-time workers at the commune level is the monthly allowance immediately preceding retirement, reserved by the central budget for allowance funds to pay.
In case a non-professional activist at the commune, village or residential group concurrently performs the duties of another non-professional activist at the commune, village or residential group level, the current monthly allowance to be calculated as the allowance is the monthly allowance of the current position, not the monthly allowance of the concurrent position.
Clause 4, Article 5 of Decree No. 154/2025/ND-CP stipulates the working period with compulsory social insurance contributions for subjects of staff streamlining.
In which, working time is counted as the total time of compulsory social insurance payment in agencies of the Party, State, Vietnam Fatherland Front, socio-political organizations from the Central to the commune level and armed forces but have not received severance pay, one-time social insurance benefits or have not received demobilization and discharge benefits.
Accordingly, regarding allowances and determining the time to calculate the staff reduction allowance for non-professional workers, the Ministry of Home Affairs requests the Department of Home Affairs of Dong Nai province to base on the above regulations to implement.
