The Ministry of Public Security is currently seeking comments on the draft Penal Code (amended).
One of the contents that attracted much attention is that the draft Penal Code (amended) has added a number of new crimes and acts:
Regarding criminalization of some new crimes, the Ministry of Public Security proposes:
- Crime of breach of personal data;
- Crime of illegally buying and selling personal data;
- Crime of obstructing personal data protection activities;
- Crime of establishing or participating in criminal organizations;
- Crime of proliferation of weapons of mass destruction;
- Crime of financing the proliferation of weapons of mass destruction;
- Crime of producing and trading food, foodstuffs, food additives, and feed used for animal husbandry that violate regulations on quality;
- Crime of violating regulations on treating ordinary waste and solid domestic waste;
- Crime of illegal fishing...
Regarding criminalizing some new acts, the Ministry of Public Security proposes:
- Supplementing the act of producing, trading, and trading N2O gas (laughing gas) used for illegal purposes in Article 191 (Crime of storing and transporting prohibited goods);
- Supplementing the act of commanding and controlling unmanned aerial vehicles or other aircraft that violate regulations on air traffic safety, with the actual possibility of leading to consequences causing damage to the life, health or property of others if not promptly prevented or affecting the normal operation of 10 or more flights in Article 277 (Crime of violating regulations on aircraft control);
- Supplementing the act of not complying with the decision to call citizens for health checks to perform the obligation to participate in the People's Police, the decision to call citizens to perform the obligation to participate in the People's Police in Article 332 ( Crime of evading military service).
Regarding the basis of the above-mentioned supplementary proposals, the Ministry of Public Security said that, based on the results of the implementation of the 2015 Penal Code and the process of summarizing the Penal Code, it shows that many new acts have appeared that are dangerous to society, causing public outrage, directly infringing upon the rights and interests of individuals and organizations, especially in the field of network security.
On the other hand, the above proposals are aimed at continuing to internalize international conventions and treaties of which Vietnam is a member.
