On the afternoon of December 5, the National Assembly discussed the draft Law amending and supplementing a number of articles of the Law on Receiving Citizens, the Law on Complaints, and the Law on Reprimand.
Commenting on the responsibility of the Chairman of the People's Committee at the commune level to directly meet citizens, delegate Nguyen Tam Hung (HCMC Delegation) completely agreed with the requirement for the Chairman of the People's Committee at the commune level to directly meet citizens at least 2 days a month, in order to enhance the role of the leader.
The delegate also proposed to establish a mechanism to strengthen the personal responsibility of the head in cases of delay or avoidance of receiving citizens, prolonging the time limit for settlement or transferring don- papers.
The delegate stated that practice shows that many cases of prolonged complaints and denunciations do not stem from the complexity of the case but from avoiding responsibility.
Linking the responsibility of the head with the results of receiving citizens and handling complaints and denunciations will increase the effectiveness and substance of the system.

Delegate Tran Van Tuan (Bac Ninh Delegation) said that the draft Law stipulates that the Chairman of the Commune People's Committee has the authority to resolve first-time complaints against administrative decisions issued by him.
However, according to current regulations, as well as in the draft law, there are not full regulations on the authority to resolve complaints for administrative decisions issued by the organizing agency, including the People's Committee at its level.
Therefore, the delegate proposed to amend and supplement: The Chairman of the People's Committee at the commune level has the authority to resolve initial complaints against his/her administrative decisions and administrative acts, of the People's Committee at the commune level, of the head of another professional agency or administrative organization under the People's Committee at the commune level, of civil servants and public employees under his/her direct management.
The delegate also suggested that it is necessary to clearly stipulate that the Chairman of the Provincial People's Committee has the authority to resolve initial complaints against administrative decisions, administrative acts of himself and the Provincial People's Committee.
Speaking to clarify the opinions raised by delegates, Government Inspector General Doan Hong Phong explained the regulation on heads receiving citizens, subjects receiving citizens and organizing the citizen reception apparatus at the commune level.
According to the Government Inspector General, the delegates proposed to supplement the mechanism of authorizing deputy citizens' reception, expand the subjects of citizen reception, and regulate the establishment of citizen reception committees at the commune level.
Regarding this content, the draft law continues to inherit current regulations, which is not to allow the authorization to receive citizens to deputy heads to enhance the direct responsibility of heads, ensuring compliance with Directive 35 and Conclusion 107 of the Politburo.
Regarding the subjects receiving citizens, the Government Inspector General said that current laws have fully regulated, accordingly, the subjects receiving citizens at all levels, sectors, agencies, units, socio-political organizations... have been specifically regulated in the Law on Receiving Citizens and related specialized laws.
To avoid the emergence of new organizations and in line with the policies of the Party and State on streamlining the organizational apparatus, the draft law "does not add a model of commune-level citizen reception" but arranges a number of civil servants under the appropriate unit of the People's Committee at the commune level to be responsible for receiving citizens and handling complaints and denunciations.
