Specifically, Clause 2, Article 42 of Decree 200/2025/ND-CP stipulates:
Regime for people on duty
1. Number of people on duty
a) At the National Civil Defense Steering Committee prescribed by the Head of the National Civil Defense Steering Committee;
b) At any level of the Civil Defense Command, the Head of the Civil Defense Command at that level shall prescribe.
2. Civil servants, public employees, and workers on overtime duty are entitled to and receive overtime wages according to the provisions of Articles 98, 104, 105, 106, 108, and 55 of the Labor Code and Articles 55, 56, and 57 of Decree No. 145/2020/ND-CP dated December 14, 2020 of the Government detailing and guiding the implementation of a number of articles of the Labor Code on working conditions and labor relations.
3. People on duty at night, from 10:00 p.m. to 6:00 a.m. the following day at advisory and support agencies for the National Civil Defense Steering Committee and the Civil Defense Command at all levels are entitled to additional meals calculated according to the day as follows:
Level 1: For those who have worked for 4 hours or more, they will receive an additional allowance equal to the basic allowance for 1 day of the militia mobilized for service.
Level 2: People with a time of 2 hours to less than 4 hours are entitled to an additional allowance equal to 0.5 of the basic allowance for 1 day of the militia mobilized for service.
4. The cost of overtime wages and overtime meals for civil defense duties is included in the budget for regular expenditures to perform civil defense tasks of ministries, branches and localities.
Thus, from August 23, 2025, civil servants, public employees and workers will receive overtime wages according to the provisions of Articles 98, 104, 105, 106, 108, 2019 Labor Code and Articles 55, 56, and 57 of Decree 145/2020/ND-CP when on duty for overtime civil defense.
