On July 13, in Hanoi, the Standing Committee of the Committee for Science, Technology and Environment organized a preliminary appraisal meeting for the draft Law amending and supplementing a number of articles of 4 laws including: Radio Frequency Law, Telecommunications Law, Electronic Transaction Law and Technology Transfer Law.
According to the Submission of the draft Law, through the process of organizing the implementation of the above-mentioned Laws, problems and inadequacies in some regulations have been revealed.
Especially in implementing administrative procedures, business conditions, conditional investment and business lines, defining state management authority and requiring to ensure the unity and synchronization of the legal system.
On that basis, the Government proposes to amend and supplement the provisions of the above 4 laws in order to fully institutionalize the guidelines and policies that have been decided by the Government in the above Resolutions.
Director of the Legal Department, Ministry of Science and Technology Nguyen Nhu Quynh clearly stated that the draft Law focuses on amending and supplementing the following contents: decentralization, delegation of power; reducing and simplifying administrative procedures, investment and business conditions.
At the same time, legalize the mechanisms that have been implemented according to the Government's resolutions and decrees and improve the management mechanism in the fields of radio frequency, telecommunications, electronic transactions, and technology transfer.
Presenting the draft Preliminary thẩm tra report of the draft Law, Deputy Chairman of the Committee for Science, Technology and Environment Do Duc Hong Ha said that the draft Law has closely followed the Party's guidelines and policies, ensuring constitutionality and legality.
However, it is proposed that the Government clarify the alternative post-inspection method corresponding to the conditions and procedures being reduced.
Speaking at the meeting, Member of the Party Central Committee, Vice Chairman of the National Assembly Nguyen Hong Dien proposed to continue to carefully review in order to cut back on procedures, administrative procedures, investment and business conditions that are no longer appropriate, and contents that are duplicated or no longer necessary to create the most favorable conditions for businesses.
At the same time, resolutely eliminate the mindset of "if you can't manage, then ban" and distorted procedures that cause difficulties for businesses; in addition, it is necessary to ensure compliance with international commitments that Vietnam has signed.
The Vice Chairman of the National Assembly proposed to continue to study, clarify and fully stipulate corresponding alternative management methods; with the consistent spirit of strongly shifting from pre-inspection to post-inspection, from the form of management by licensing to management by standards, regulations and practical supervision.
