On April 1, the Government Inspectorate publicly announced the Conclusion of the inspection of the responsibility for state management of planning and implementation of construction planning of the Ministry of Construction.
Notably, inspecting 18 documents pointed out by the Department of Construction Management, the People's Committee of Bac Ninh province, the People's Committee of Ba Ria - Vung Tau province, and the People's Committee of Vung Tau city approved the detailed planning and project but not in accordance with the approved general construction planning.
The People's Committee of Bac Ninh province approved the Investment Project to build a complex of commercial centers and apartments for sale at New Melboume on a land area of 2,160 m2 invested by Royal Company Limited, but according to the Bac Ninh Urban Master Plan approved by the Prime Minister and the Land Use Plan Map appraised by the Ministry of Construction, the location of that land is public land.
The People's Committee of Bac Ninh province approved the Investment Project to build a Service Commercial Building, office and apartment for sale on an area of 4,108.9m2 invested by Dabaco Vietnam Group Joint Stock Company, but according to the Bac Ninh Urban Master Plan approved by the Prime Minister and the Land Use Plan Map appraised by the Ministry of Construction, the location of the land in the planning map is public land.
"This is an implementation that is not in accordance with the provisions of Article 5, Article 61 of the Law on Urban Planning No. 30/2009/QH12 dated June 17, 2009" - the Government Inspectorate said.
Meanwhile, the People's Committee of Ba Ria - Vung Tau province has decided to convert Thai Duong Commercial Center to Commercial Apartment, which has changed the nature, function, scale and main solutions of the zoning plan area (increasing the number of floors from 12 floors to 36 floors, population increase to 2,937 people) compared to the Decision approving the 1/2,000 scale planning of Nam San Bay residential area, Vung Tau city, which is not enough basis, basis and is not in accordance with the provisions of Point a, Clause 2, Article 49 of the Law on Urban Planning.
In addition, the inspectors also pointed out that the People's Committee of Vung Tau City has decisions to adjust the function of land from public land to apartment land (residential land) such as changing land use indicators, changing functions, properties, and scale, leading to an increase in the population size in the area, affecting the organization of space, architecture, and landscape for the area, changing social infrastructure works and technical infrastructure works.
The inspection conclusion also pointed out that Forio Nha Trang Company Limited, the investor of the Van Phong luxury hotel project, did not construct the project in accordance with the planning and construction targets and parameters; violated planning and construction approved by the competent state management agency.
Therefore, the Government Inspectorate recommends that the Prime Minister direct the People's Committees of the above localities to conduct a review and clarify the responsibility of relevant collectives and individuals for the shortcomings, limitations and shortcomings.
"During the inspection, review and implementation of the Inspection Conclusion, if there are signs of criminal law violations discovered, the Ministry of Construction and the People's Committees of relevant provinces and centrally run cities will transfer the case file to the investigation agency for consideration and handling in accordance with the provisions of law" - the Inspection Conclusion stated.
