At a press conference on the afternoon of June 18 organized by the Ministry of Home Affairs, Deputy Director of the Department of Employment (Ministry of Home Affairs) Chu Thi Hanh said that according to current regulations, the Prime Minister decides specifically the Lunar New Year and National Day holiday schedule every year. The remaining occasions such as the Gregorian New Year, Hung Kings Commemoration Day, April 30 and May 1 are implemented according to the fixed regulations of the Labor Code.
In the draft Law amending and supplementing a number of articles of the Labor Code, the Law on Archives, the Law on Gender Equality and the Law on Red Cross Activities, the Ministry of Home Affairs believes that assigning the Prime Minister to decide on the entire holiday schedule will help proactively arrange holidays and notify people and businesses early.
According to Ms. Hanh, in fact, there are years when holidays fall on weekends or are interspersed between working days, leading to the need to swap to create continuous holidays. However, the adjustment currently requires consulting many ministries and sectors before summarizing and submitting to competent authorities for consideration.

If implemented close to the holiday time, it will make it difficult for agencies, businesses and people to proactively arrange plans. When assigned the authority to decide on the entire holiday schedule, the Prime Minister can consider a holiday plan right from the beginning of the year, and the Ministry of Home Affairs will proactively advise and notify early" - Ms. Hanh said.
According to the provisions of the 2019 Labor Code, employees are entitled to leave work and receive full salary on holidays and Tet every year.
Article 112 clearly states holidays including: New Year's Day (1 day), Lunar New Year (5 days), April 30th Victory Day (1 day), International Labor Day May 1st (1 day), National Day September 2nd (2 days) and Hung Kings Commemoration Day (1 day, March 10th lunar calendar). Workers who are foreigners working in Vietnam, in addition to the above days, are also entitled to 1 more day of traditional Tet and 1 national day of their country.
After institutionalizing the policy of the Politburo, in 2026, people nationwide will have 1 more holiday day, increasing the number of holiday days to 12 days.
