This principle has brought about great achievements in the operating mechanism of “Party leadership, State management, people mastery” in our country.
Some urgent solutions
In reality, especially through prominent cases and incidents involving a number of party members, including many party members holding high positions, it can be seen that: A number of cadres, party members and party organizations have not clearly understood the principle of "The Party operates within the framework of the Constitution and the law" as stated.
Associate Professor, Dr. Vu Van Phuc - Vice Chairman of the Scientific Council of the Central Party Agencies - analyzed that some manifestations of this have been pointed out by competent authorities, such as: Some Party Committees abuse their leadership power, deeply intervening in government and judicial activities. A number of Party members violate the law, especially in the economic field with serious nature and level. Some officials and Party members take advantage of their positions and powers to commit corruption, negativity, cover up illegal economic activities, let their wives, children, and relatives profit from their positions and powers...
From that reality and through analysis, experts and scholars believe that there must be solutions to limit and prevent the above situation. In particular, it is necessary to focus on some contents:
Firstly, continue to vigorously implement the groups of tasks and solutions set forth by the 13th Central Committee's 4th Conference, which is to carry out more synchronously and drastically the work of Party building and rectification, building a socialist rule-of-law State and a comprehensive, clean and strong political system.
In addition, it is necessary to build a team of cadres at all levels, especially strategic levels and leaders with sufficient qualities, capacity and prestige, equal to the task; resolutely and persistently fight against corruption and negativity, and strictly handle erring cadres.
Second, strengthen propaganda and education to raise awareness of responsibility for Party committees at all levels and cadres and Party members on the principle that the Party operates within the framework of the Constitution and the law; focus on strictly implementing the regulations of the Party Central Committee on what Party members are not allowed to do.
Third, specify in detail the leadership role and activities of the Party, properly resolve the relationship between compliance with the Party Charter and compliance with the law by Party members. Promote the role of heads of Party committees and authorities.
Fourth, focus on streamlining the apparatus and organization of Party agencies. Research and promote the consolidation of a number of Party advisory and support agencies; promptly and comprehensively assess the concurrent holding of Party and political system positions to make appropriate decisions.
