One of the notable contents in the draft Law on Civil Servants (amended) proposed by the Government is the regulation on the rights of civil servants.
In particular, the rights of civil servants regarding salaries, bonuses and salary-related regimes are arranged in accordance with the provisions of the Law on Cadres and Civil Servants in Article 12 of the draft law.
In particular, civil servants are entitled to salaries, bonuses and other income based on the results and work efficiency according to the job position.
They are entitled to overtime pay, night work wages, work fees and other regimes according to the provisions of law and the internal spending regulations of the unit.
Officials working in mountainous areas, border areas, islands, remote areas, ethnic minority areas, areas with particularly difficult socio-economic conditions or in industries and professions with toxic and dangerous environments, or specific career fields are entitled to preferential policies according to the provisions of law.
In addition, the right of civil servants to sign contracts for professional activities and business activities is also clearly stated in Article 13.
Civil servants who sign labor contracts or service contracts with other agencies, organizations, or units, if not contrary to the agreement in the work contract and the law does not prohibit it. In case there is no agreement in the work contract, it must be agreed by the head of the public service unit; for management officials, it must be agreed by the competent authority appointing them.
They are allowed to contribute capital, participate in managing and operating enterprises, cooperatives, hospitals, educational institutions, and organize scientific research in the non-public sector, except where otherwise provided by the law on corruption prevention and control or specialized law.
Officials are also allowed to exercise other rights in business activities according to the provisions of the law on professional activities and the regulations of competent authorities.
