People over 75 years old without official pensions are entitled to social pension benefits

Citizens aged 75 and over who do not receive monthly pension or social insurance benefits will receive social pension benefits.

The Government issued Decree 176/2025/ND-CP detailing and guiding the implementation of a number of articles of the Law on Social Insurance on social pension benefits.

This Decree stipulates in detail and guides implementation on subjects and conditions for receiving social pension benefits; social pension benefits levels; procedures for implementing social pension benefits; support for funeral expenses; funding and payment of social pension benefits.

According to the decree, Vietnamese citizens are entitled to social pension benefits when they meet the following conditions:

1. From 75 years old and above.

2. Not receiving monthly pension or social insurance benefits, or receiving monthly pension or social insurance benefits lower than the pension benefits prescribed in this decree.

3. Having a written request to receive social pension benefits.

In case of belonging to a poor household or a near-poor household, only 70 years old to under 75 years old and meeting the conditions in points b and c above.

The monthly social pension benefit is 500,000 VND/month.

In case of being a beneficiary of monthly social allowance, they will receive a higher allowance.

Depending on socio-economic conditions, the ability to balance the budget and mobilize social resources, the People's Committee at the provincial level shall submit to the People's Council of the same level a decision on additional support for social pension beneficiaries.

Applicants for social pension benefits who have a written request for social pension benefits under form No. 01 issued with this Decree shall send directly or through a postal organization or online to the Chairman of the People's Committee (UBND) at the commune level.

Within 10 working days from the date of receipt of the document requesting social pension benefits, the Chairman of the People's Committee at the commune level shall review, authenticate and standardize the relevant information of the social pension benefits candidate with the national database on population, decide and pay social pension benefits to the candidate according to the law.

The period of receiving monthly social pension benefits is calculated from the month in which the Chairman of the People's Committee at the commune level signs the decision.

In case the candidate is not eligible for social pension benefits, the Chairman of the People's Committee at the commune level will respond in writing, stating the reason.

In case the subject receiving social pension benefits changes the place of residence and requests to receive social pension benefits at the new place of residence, the Chairman of the People's Committee of the commune where the old place of residence decides to stop paying social pension benefits in the area and have a document attached to the relevant documents of the person requesting the Chairman of the People's Committee of the commune where the new place of residence of the person requesting.

The Chairman of the People's Committee of the new commune where he or she resides shall, based on the relevant documents of the person requesting the payment, consider the decision to continue paying social pension benefits and pay social pension benefits from the month of ceiling payment at the old place of residence.

This Decree takes effect from July 1.
