On the afternoon of September 23, continuing the 49th Session, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Intellectual Property.
Giving his opinion on the discussion, Chairman of the Committee for Culture and Society Nguyen Dac Vinh mentioned content related to journalism.
Mr. Vinh said that the current Law on Intellectual Property stipulates that subjects not covered by copyright protection have pure and accurate immediate reporting information. However, the revised draft law does not amend but still keep this provision.
Therefore, Mr. Vinh stated that in reality, press agencies create original news but then electronic news sites are synthesized and gathered information.
"The reads see the general information page more and the general information page earns much more money than those who create the original news. While the brothers wrote the original news, it was much more difficult, the effort and thinking were much more" - Chairman of the Committee for Culture and Society Nguyen Dac Vinh said.
From the above evidence, Mr. Nguyen Dac Vinh suggested that the drafting agency study and handle the original law - Law on Intellectual Property to ensure the rights of the press.
At the same time, Mr. Vinh suggested that the Ministry of Culture, Sports and Tourism should amend in the direction of having more agreements between official press agencies.
"We encourage reporting to replicate information, but we should have an agreement with each other to increase the benefits for the press to make original news. Along with that, legitimate press agencies have more legitimate sources of income for development" - Mr. Vinh emphasized.
At the meeting, Deputy Minister of Culture, Sports and Tourism Ho An Phong analyzed that according to the provisions of the Law on Intellectual Property when reporting regular information such as the meeting of the National Assembly Standing Committee, piece of information, weather... are not subject to copyright protection. When it becomes a complete " joyalty work", it is completely protected.
This person added that the regulation on press works is works with independent content and complete structure including the genres of reporting, short-story, reporting, interviewing, reflection, investigation, commentary... to be published in spoken newspapers, print newspapers, visual newspapers, electronic newspapers or other means.
Meanwhile, Minister of Science and Technology Nguyen Manh Hung said that currently, news sites and social networks use information from the press a lot, "the press is very complacent".
According to Minister Nguyen Manh Hung, many news sites are not newspapers but have much larger revenue than press agencies. Notably, their number is only 5 people because they only use technology to copy and post.
Regarding copyright protection, according to Minister Nguyen Manh Hung, pure news is not protected but should be protected for press works.
