According to National Assembly Delegate Pham Van Hoa, the Law amending and supplementing a number of articles of the Law on Social Insurance (SI) and Health Insurance (HI) effective from January 1, 2025, clearly stipulates the responsibilities and rights of social insurance participants, insurance subjects and insurancepayers, including civil servants, public employees, employees and business owners.
The law also has very clear and specific regulations on prohibitions, rights, as well as responsibilities and obligations of the parties. This is something we are very concerned about, especially the rights of workers who have paid insurance in the past - Delegate Pham Van Hoa said.
Mr. Hoa said that for state-owned enterprises, compliance is relatively favorable. But the worrying reality is that in the non-state enterprise sector, many enterprises, both large and small, have avoided or delayed paying social insurance for employees. As a result, when employees reach retirement age or quit their jobs, employees come to the social insurance agency to enjoy benefits and receive the answer that the enterprise has not paid or is late in paying social insurance and is not entitled to the regime. This is a major problem that has existed in the past.
The revised Law on Social Insurance clearly stipulates responsibilities and benefits. If the violation is serious, criminal liability may be prosecuted or administrative sanctions may be imposed gradually. However, according to information from Vietnam Social Security, there are still many businesses, even large businesses, that are slow or evade social insurance payments with amounts up to billions of VND. This is unacceptable, directly affecting the legitimate rights of workers" - Mr. Hoa emphasized.
According to the delegate, the responsibility of Vietnam Social Insurance is the responsibility of enterprises that evade and delay social insurance payments for a long time. At the same time, the problem of lack of determination in implementation is raised, causing workers to not enjoy the policy.
Who will be responsible for this? Social Insurance Agency or business owner? What is the cause of this existence? Is it due to the respect and consideration of the insurance agency for the business? Why are there cases of 2-3 year of late payment that are not thoroughly handled, while the social insurance agency certainly has the information? The rights of workers, who do not always have the conditions to closely monitor the insurance payment of enterprises, will go where?" - Mr. Hoa raised the question.
To solve the problem of enterprises evading and delaying social insurance payments for a long time, affecting the rights of employees, delegate Pham Van Hoa said that there should be synchronous solutions from many relevant parties.
First of all and most importantly, the insurance agency must take drastic action and strictly implement the provisions of the law. It is necessary to clarify the responsibility for prolonged prolonged prolonged payment and evasion of social insurance payment. There cannot be any respect or cover-up for businesses.
On the business owner's side, there must be responsibility towards the employees. Employment must go hand in hand with the obligation to pay social insurance in full and on time. Workers also need to be propagandized to proactively monitor and check their social insurance payment status. When discovering that a business is not paying, it is necessary to immediately file a complaint to ensure its legitimate rights.
