According to Article 35 of the Law on Social Insurance 2024, the Social Insurance agency is responsible for detecting and urging in writing employers who are late in paying or evade paying insurance. At the same time, the list of violating units must be made public on the Electronic Information Portal and information must be sent to State management agencies and relevant inspection agencies for consideration and handling according to their authority. Along with that, Point c, Clause 1, Article 48b of the Law on Health Insurance 2024 clearly stipulates that if a business fails to pay or does not pay enough after 60 days from the deadline and has been urged by a competent authority, it will be handled according to Government regulations.
This is a new point that shows the tightening in management work, emphasizing the role and responsibility of the Social Insurance agency in urging, monitoring and handling violations. The results of this urging will be an important basis for handling other violations of social insurance and health insurance in practice.
Speaking to Lao Dong Newspaper, Mr. Le Dinh Quang - former Deputy Head of the Labor Relations Department of the Vietnam General Confederation of Labor - said that current laws have created a full corridor for collecting and handling businesses that are late and evading social insurance payments. However, in reality, the number of violations is still high, showing that it is necessary to reconsider the responsibilities of organizations and individuals assigned to collect.
According to Mr. Quang, the Social Insurance agency has been given many additional legal tools for management, but if the situation of debt and evasion continues, not only the violating enterprise but also the implementing enterprise must take responsibility.
Mr. Le Dinh Quang proposed that it is necessary to clearly qualify the responsibilities of individuals and social insurance collection units. The rate of late payment and evasion of insurance can be considered one of the criteria for evaluating emulation, reward, and even associated with the income of cadres doing this work.
He emphasized that the law has clear regulations, but the issue is implementation. The responsibility of the Social Insurance agency does not stop at urging and publicizing, but must also resolutely handle cases of lax management and failure to complete the collection task.
"To improve efficiency, we must increase sanctions for both violators and enforcement. When insurance collectors are considered for responsibility, linked to income, and rewards, industry discipline will truly take effect" - Mr. Quang emphasized.
