The book "Handbook of organization and operation of local authorities at the commune level" was compiled by the Ministry of Home Affairs (in paper and electronic versions).
The content of the "Local Government at the Commune Level" Handbook is designed in a practical and clear direction, concretizing responsibilities, tasks, powers, working relationships and handling situations arising at the grassroots level, ensuring unity and effectiveness in organization and implementation.
In the handbook, the Ministry of Home Affairs has responded to a number of related contents when implementing the 2-level local government model. In which cases is there a question, in which cases is the Chairman of the People's Committee at the commune level allowed to decide on issues under the authority of the commune-level People's Committee?
Responding to this question, in the notebook, the Ministry of Home Affairs clearly stated that Clause 16, Article 24 of the Law on Organization of Local Government stipulates that the Chairman of the Commune People's Committee is allowed to represent the People's Committee at his level to decide on issues under the authority of the People's Committee and report to the People's Committee at the most recent meeting, except for issues that the People's Committee discusses collectively and decides by majority (Clause 2, Article 40.) as follows:
Draft Resolution of the People's Council, draft Decision of the People's Committee according to the provisions of the Law on Promulgation of Legal Documents;
5-year and annual socio-economic development plan; public investment plan; state budget estimate and local budget allocation plan; adjustment of local budget estimates; state budget settlement to report to competent authorities according to regulations.
The People's Committee at the provincial level discusses and decides on strategies, mechanisms, policies, types of planning, 5-year financial plans and 3-year state financial and budget plans of the province and city to report to competent authorities according to regulations; regimes, standards, and budget expenditure norms assigned by the People's Council at the same level;
Report on the socio-economic situation monthly, quarterly, every 6 months, all year round or important, unexpected issues and tasks and solutions to direct and manage the implementation of the socio-economic development plan;
The organizational structure of the People's Committee; the establishment and termination of specialized agencies and other administrative organizations under the People's Committee; establishment, dissolvement, merger, division of administrative units, adjustment of boundaries and renaming of administrative units at all levels to report to competent authorities according to regulations;
The annual work program of the People's Committee; review the direction and operation of the People's Committee, Chairman of the People's Committee and the implementation of the Working Regulations of the People's Committee;
Other issues shall be at the request of the Chairman of the People's Committee or at least one-third of the total number of members of the People's Committee.
