Mr. Nguyen Van Cao (character's name has been changed) cited Circular No. 09/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of special allowances for cadres, civil servants, public employees and armed forces, stating: "Special allowances are only paid for months of actual work in the area, when leaving the area for a month or more or when working less than a month, they will not be entitled to them".
From the above regulation, he raised the question: In case a civil servant comes to work in the area with a special allowance from February 2, 2025 to April 14, 2025, how will the period of special allowance be calculated? Only in March 2025, or in February and April?
Regarding Mr. Cao's reflection and recommendation, the Ministry of Home Affairs said that Circular No. 09 2005 of the Minister of Home Affairs guiding the implementation of the special allowance regime for cadres, civil servants, public employees and armed forces has specifically stipulated and how to calculate special allowances.
Accordingly, the special allowance is calculated in percentage of the current salary plus leadership position allowance and seniority allowance beyond the framework (if any) or current military rank allowance for non-commissioned officers and soldiers of the armed forces.
The allowance includes 3 levels: 30%; 50% and 100% applied to subjects specified in Section I of this Circular working in the area specified in the appendix issued with this Circular.
The Ministry of Home Affairs gave an example, Mr. Vu Van A, Lieutenant of the Vietnam People's Public Security, with a current salary coefficient of 4.60, the salary implemented from October 1, 2004 is 1,334,000 VND/month; working in the area is subject to a special allowance of 50%.
In this Circular, in 2004, the Ministry of Home Affairs instructed Mr. A to receive a special allowance of: 1,334,000 VND/month x 50% = 667,000 VND/month.
However, from July 1, 2024, the basic salary is 2,340,000 VND/month. Therefore, in 2025, Mr. A will receive a special allowance of: VND 2,340,000/month x 50% = VND 1,170,000/month.
Regarding the calculation method, according to the Ministry of Home Affairs, special allowances are calculated according to the workplace with the same monthly salary or military rank allowance and are not used to calculate social insurance contributions and benefits.
Special allowances are only paid for months of actual work in the area, when leaving the area for a month or more or working for less than a month, they will not be entitled to them.
Sources of funding for special allowances: Subjects under agencies and units fully guaranteed by the state budget, Special allowances paid by the state budget according to the current budget decentralization in the budget estimate allocated annually to the agency or unit;
Subjects belonging to agencies implementing personnel contracts and administrative management funds and subjects belonging to public service units implementing financial autonomy, special allowances paid by agencies and units from contract funding sources and financial sources assigned to autonomy.
The organization and implementation of policies for cadres, civil servants and public employees in Khanh Hoa province is under the authority of the Provincial People's Committee.
