The Decree specifically stipulates the organization of the One-Stop Department at the ministerial, provincial and commune levels.
Accordingly, at the ministerial level, based on the number of administrative procedures under the authority of the settlement, the frequency of receiving documents and the situation of headquarters arrangement, the Minister and Head of the ministerial-level agency decides to establish a Receiving and Results Retursement Department at the ministry, the ministerial-level agency under the ministerial Office, the ministerial-level agency or at the agency, unit under the Ministry, the ministerial-level agency.
In case of establishing a Resolution and Returnance Department at agencies and units under the Ministry, ministerial-level agencies, ministerial-level offices, and ministerial-level agencies, monitor, supervise, and urge the implementation of the one-stop, one-stop mechanism at these agencies and units through the Information System for handling ministerial-level administrative procedures.
For central agencies organized according to the local vertical sector system, the head of the agency shall arrange cadres, civil servants, and public employees to work at the Provincial Public Administration Service Center, Commune-level Public Administration Service Center to receive and handle administrative procedures for administrative procedures under the authority prescribed in Point c, Clause 2, Article 14 of this Decree.
Based on the principles and other provisions in this Decree, the Minister of National Defense and the Minister of Public Security decide on the implementation of the one-stop, one-stop mechanism in accordance with the working conditions of each ministry.
Pursuant to this Decree, other relevant provisions of law and international treaties that the Socialist Republic of Vietnam has signed or joined and the conditions and circumstances of each country and locality, the Minister of Foreign Affairs decides on the implementation of the one-stop, one-stop mechanism to resolve administrative procedures at diplomatic missions, consular missions, and representative agencies of Vietnam at international organizations abroad.
At the provincial level, the Provincial People's Committee decides to establish a Provincial Public Administration Service Center as an administrative organization under the Provincial People's Committee Office, with its own seal and account to perform assigned tasks and powers.
In centrally-run cities, based on the specific consideration of population management..., the City People's Committee decides to establish a Provincial Public Administration Service Center as an administrative organization under the City People's Committee (hereinafter referred to as the One-level Public Administration Service Center) and decide on the number of branches under the One-level Public Administration Service Center to perform tasks within the locality.
Meanwhile, at the commune level, the People's Committee at the commune level decides to establish a Commune-level Public Administration Service Center as an administrative organization under the People's Committee at the commune level, with its own seal and account to perform assigned tasks and powers.
The People's Committee at the commune level decides on the arrangement of points for receiving and returning administrative procedure settlement results of the Commune-level Public Administration Service Center at the local level based on the natural area, population size, local socio-economic conditions and number of administrative procedure records.
Not organizing Commune-level Public Administration Service Centers under the People's Committees at the commune level in localities that choose the model of One-level Public Administration Service Centers under the Provincial People's Committees.
The Decree takes effect from July 1, 2025.
