The Government Inspectorate has just published the Conclusion of the inspection of the responsibility for state management of planning and implementation of construction planning of the Ministry of Construction.
In particular, checking the Ministry of Construction's appraisal and consensus on a number of planning projects of 4 provinces (Bac Ninh, Thai Nguyen, Khanh Hoa, Ba Ria - Vung Tau provinces), the inspection agency found that:
The Ministry of Construction appraises planning tasks, appraises planning projects that are often slow and not on time as prescribed; People's Committees of localities set up planning tasks, set up planning projects that often last not on time as prescribed;
The Ministry of Construction's failure to issue a decision to establish an Appraisal Council (from 2015 to 2019) is not in accordance with the provisions of Article 42 of the Law on Urban Planning.
The Ministry of Construction when appraisal does not evaluate the conditions of response to the planning consultancy organization in accordance with Article 43 of the Law on Urban Planning; not following the content of planning tasks, data on population and land in the approved planning task; Do not request local People's Committees to explain and clarify the contents of changing land use purpose in the general planning before consistent opinions.
Regarding some projects prepared by the Ministry of Construction and submitted to the Prime Minister for approval:
Checking 4/12 planning projects made by the Ministry of Construction, submitting to the Prime Minister for approval (the project to adjust the construction planning of the Capital region to 2030 with a vision to 2050; Ha Giang urban planning project, Ha Giang province, by 2035 vision to 2050; the project to adjust the construction planning project in Ho Chi Minh City to 2030 vision to the Mekong Development Plan to 2030 to reach the planning of the Mekong Development region until the year of the River and the Mekong Development Plan until 20 2050), notice:
The Ministry of Construction and related units organize the preparation of urban planning projects and construction planning, including tasks and projects that are often slower than those prescribed by law and the requirements of the Prime Minister;
The Ministry of Construction organizes the selection of consulting units to establish tasks and planning projects in the form of assigning tasks to public service using the state budget without going through the form of bidding designation; appointing consulting units for bidding that are not subject to bidding; inviting an inadequate number of foreign consulting contractors when selecting foreign consultants to establish plans is not in accordance with regulations...
On that basis, the Government Inspector General has proposed the Prime Minister to direct the Ministry of Construction to conduct reviews, clarify collective responsibilities and related individuals under the Ministry of Construction's leaders in the occurrence of shortcomings, limitations and shortcomings in implementing the state management function on planning and implementation of construction planning.
