The Ministry of Home Affairs has just responded to the case of the village Party cell secretary resigning after village merger.

Mr. Nguyen Duc (name of the character changed) said that he was born in 1992, is a non-specialized worker at the commune level until the end of June 30, 2026. From that time until now, he has held the position of Secretary of the village party cell.

After merging 3 villages into 1 new village, out of a total of 8 non-specialized titles of 3 old villages (including 1 concurrent title), 6 people do not meet the conditions to hold 3 non-specialized titles of the new village according to the provisions of Decree 185/2026/ND-CP and the resolution of the Provincial People's Council. Only he and one other person meet the conditions on qualifications and age.

On that basis, Mr. Duc asked, if you voluntarily resign, will you be entitled to policies according to Decree 154/2025/ND-CP or not.

Regarding Mr. Duc's proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.

Accordingly, Decree No. 154/2025/ND-CP and Decree No. 185/2026/ND-CP have clearly stipulated the subjects of application as non-specialized workers in villages and residential groups resigning due to village and residential group arrangement.

At the same time, Article 12 and Article 14 of Decree No. 154/2025/ND-CP have decentralized to local authorities in resolving staff streamlining policies for cadres, civil servants, public employees and employees under their management authority.

Accordingly, the Ministry of Home Affairs requested him to contact the competent authority in the locality for resolution.
