Ministry of Home Affairs sets conditions for receiving non-specialized personnel to become civil servants

The Ministry of Home Affairs has clarified the conditions for non-specialized personnel to be considered for recruitment into civil servants according to Decree No. 170/2025/ND-CP.

Mr. Nguyen Van Nam (character name has been changed) said that based on Article 13 of Decree 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants, he is concerned about whether he is eligible to be considered for recruitment as a civil servant or not.

According to Mr. Nam, before July 1, 2025, he was a non-specialized worker. Previously, from October 2009 to January 2022, he was an employee at a non-business unit with intermediate qualifications, and also performed professional work and was in charge of many administrative tasks such as agency clerical work, summarizing reports, advising on plans, managing assets and monitoring health insurance. The total working time and participation in social insurance during this period was 12 years and 4 months.

After that, he continued to work as a non-specialized worker in the Office position for 3 years and 7 months. He was awarded a university degree in April 2021 and said that his university degree had been held for over 5 years, suitable for the Office position. His total working time and compulsory social insurance participation was 15 years and 7 months.

Based on the above grounds, Mr. Nguyen Van Nam requested competent authorities to answer whether he is qualified to be considered for recruitment as a civil servant in the Office position or not.

Regarding Mr. Nam's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.

According to Clause 3, Article 13 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government stipulating the recruitment, use and management of civil servants, it is stipulated: Based on the proportion of civil servants to be arranged for each job position in the agency using civil servants, the assigned staff quota and the requirements of the job position to be recruited, the head of the agency with recruiting authority or the head of the management agency shall consider and receive them to become civil servants for the cases specified in Clause 1 of this Article if they meet the conditions for registering for civil servant recruitment according to the provisions of Clause 1, Article 19 of the Law on Cadres and Civil Servants, except for the cases specified in Clause 3, Article 19 of the Law on Cadres and Civil Servants or are in the period of disciplinary action, are in the period of enforcing disciplinary decisions, are in the period of enforcing discipline according to the provisions of the Party and law;

At the same time, Article 13 also stipulates cases where specific cases must have 5 years or more of service in accordance with the law, have compulsory social insurance contributions (if not continuously and have not received a one-time social insurance allowance, it is accumulated, including the working time if it was previously in the assigned job position), do a job with professional and nghiệp vụ requirements suitable for the job position expected to be received.

Therefore, the Ministry of Home Affairs requests him to contact the competent authority receiving civil servants for consideration and resolution.
