The Ministry of Home Affairs and the National Assembly's Law and Justice Committee are continuing to closely coordinate to complete the dossier of the draft Law on Cadres and Civil Servants (amended) to submit to the National Assembly at the upcoming 9th Session.
Minister of Home Affairs Pham Thi Thanh Tra said that the draft Law consists of 7 Chapters and 52 Articles (a reduction of 35 Articles compared to the current Law).
In particular, the draft Law devotes a full chapter to regulating the reward and disciplinary action against cadres and civil servants.
Accordingly, cadres and civil servants with achievements in public service will be rewarded according to the provisions of the law on emulation and reward.
Cadres and civil servants with outstanding achievements in public service who are awarded an unexpected or meritorious award will receive a salary increase ahead of schedule, receive bonuses from the bonus fund of the agency, organization, or unit, and will be given priority when considering appointment to a higher position if the agency, organization, or unit has a need according to regulations of the competent authority and the Government.
In addition, the draft also clearly stipulates disciplinary measures for cadres who violate the provisions of this Law and other relevant legal provisions, depending on the nature and severity of the violation, they must suffer one of the following disciplinary measures:
Reprimand; Warning; Removal from office (for cadres approved, appointed or appointed to hold positions and titles); Dismissal (for cadres elected to hold positions and titles).
For cadres who are convicted by the Court and have their judgments and decisions taken into legal effect, they will of course cease to hold positions due to election, approval, and appointment;
In case of being sentenced to imprisonment by the Court without a suspended sentence or being convicted of a corruption crime, of course, he/she will be dismissed from the date the verdict or decision takes legal effect.
The application of disciplinary measures, authority, order, and procedures for disciplinary action against cadres shall be implemented in accordance with the provisions of law, the charter of the Communist Party of Vietnam, socio-political organizations, and documents of competent agencies and organizations.
The draft Law also clearly stipulates disciplinary measures for civil servants who violate the provisions of this Law and other relevant legal provisions, depending on the nature and severity of the violation, they must suffer one of the following disciplinary measures:
Reprimand; Warning; Salary reduction (for civil servants who do not hold leadership or management positions); Removal from office (for civil servants in leadership or management positions); Forced to quit.
Civil servants sentenced to prison by a Court without a suspended sentence or convicted of corruption crimes shall be forced to quit their jobs from the date the verdict or decision takes legal effect;
Civil servants holding leadership and management positions who are convicted by the Court and their judgments and decisions have come into legal effect will of course cease to hold positions due to appointment.
The Government shall specify in detail the principles of disciplinary action; the application of disciplinary measures corresponding to violations; authority, order, and procedures for disciplinary action against civil servants.
