Accordingly, in the draft Decree of the Government regulating the organization of public service units, the Ministry of Home Affairs proposes that agencies and organizations propose the establishment of public service units send draft projects, submissions and draft documents of the agency or person with authority to decide on the establishment to relevant agencies and organizations according to the provisions of law to collect written comments on the establishment of public service units before sending them to competent agencies and organizations for appraisal.
For public service units under the decision-making authority of the Government and the Prime Minister: The proposal for establishment dossier should be sent to the Ministries of Home Affairs, Justice, Finance, Ministry of Industry Management, field of operation of public service units and related agencies (if any);
For public service units under the decision-making authority of the head of the ministry or sector: The proposal for establishment dossier is sent to collect opinions from agencies, organizations at the same level to advise on the fields: personnel organization, legal, finance and related organizations (if any); at the same time, send to collect opinions from the Ministries of Home Affairs, Justice, Finance, ministries managing sectors and fields of operation of public service units and related agencies (if any).
For public service units under the decision-making authority of the People's Committee and the Chairman of the Provincial People's Committee: The dossier proposed to be established should be sent to collect opinions from specialized agencies under the Provincial People's Committee on the following sectors and fields: internal affairs, justice, finance and sectors and fields of operation of public service units and related organizations (if any);
For public service units under the decision-making authority of the People's Committee at the commune level: The proposal for establishment dossier shall be sent for comments from specialized agencies under the People's Committee at the commune level and related organizations (if any).
Regarding the establishment of public service units abroad, it is necessary to seek additional opinions from the Ministry of Foreign Affairs, the Ministry of Finance, the Ministry of Public Security, and the Ministry of National Defense.
The consultation of other agencies and organizations (other than the agencies and organizations specified in Clauses 1 and 2 of this Article) is carried out in accordance with the provisions of specialized laws.
