The Ministry of National Defense is drafting a Decree amending and supplementing a number of articles of 3 Decrees of the Government on the one-time allowance regime when ceasing service in the army for officers, professional soldiers, workers and national defense officials.
The draft Decree proposes to amend and supplement Clause 2, Article 2 of Decree No. 21/2009/ND-CP of the Government detailing and guiding the implementation of a number of articles of the Law on Officers of the Vietnam People's Army on regimes and policies for officers who cease to serve in the army; active officers who sacrifice or die; active officers transferred to professional soldiers or defense civil servants, amended and supplemented by Decree No. 52/2025/ND-CP of the Government.
In which, there are many regulations on the regime for officers retiring early at the highest age according to military ranks specified in Clause 1, Article 13 of the Law on Officers of the Vietnam People's Army that are expected to be amended as follows:
a) Officers who are redundant due to organizational changes or changes in organizational charts and payroll according to the decision of the competent authority (except for subjects enjoying policies and regimes in implementing the arrangement of the organizational structure of the political system according to the Government's own regulations); officers who have reached the age limit for holding command and unit management positions as prescribed in Clause 3, Article 13 of the Law on Vietnam People's Army Officers and the Army no longer needs to arrange and use them, when retiring early, the highest age according to military rank is subsidized once equal to 5 months of salary for each year of early retirement;
b) Officers who do not fall into the cases specified in point a of this clause, due to organizational restructuring, restructuring, and improving the quality of the contingent of cadres, who stop holding leadership and management positions according to the decision of the competent authority or are appointed to lower leadership and management positions by the competent authority but wish to retire early and are approved by the competent authority, when retiring early, the highest age according to military rank is entitled to a one-time allowance equal to 5 months of salary for each year of early retirement;
c) Officers who are not subject to the cases specified in points a and b of this clause, in the year immediately preceding or in the year of early retirement consideration, if competent authorities conclude that they no longer meet the health standards for serving the Army, then when retiring early, the highest age according to military rank is entitled to a one-time allowance equal to 5 months of salary for each year of early retirement...
Meanwhile, according to Clause 2, Article 2 of Decree No. 21/2009/ND-CP, army officers retiring before the age limit are entitled to a one-time allowance including 3 months of salary for each year of early retirement;
Being subsidized with 5 months of salary for the first 20 years of work. From the year from 21, for each year of work, they are subsidized with 1/2 month of salary.
