This content is stipulated by the Government in Decree No. 338/2026/ND-CP dated August 26, 2026, amending and supplementing a number of articles of 3 Decrees of the Government on the one-time allowance regime when ceasing service in the Army for officers, professional soldiers, workers and national defense officials.
Decree No. 338/2026/ND-CP also amends and supplements Clause 1, Article 5 of Decree No. 21/2009/ND-CP amended and supplemented by Decree No. 52/2025/ND-CP as follows:
1. Officers who stop serving in the army and do not meet the conditions for retirement, retire according to the sick soldier regime or cannot transfer to another sector are demobilized; when demobilized, in addition to enjoying social insurance benefits and other benefits according to the provisions of current law (if any), they are also entitled to the following benefits:
a) Be entitled to job creation allowances equal to 3 months of salary; be supported with vocational training or job introduction at job introduction organizations of ministries, branches, unions, localities and other socio-economic organizations;
b) Being entitled to a one-time demobilization allowance, for each year of work with compulsory social insurance contributions, they are entitled to an allowance equal to 1.5 months of salary.
Compared to the old regulations, the level of job creation allowance for demobilized officers is changed from 6 months of basic salary to 3 months of current salary.
The level of severance allowance (employment termination) for the working period with compulsory social insurance contributions is increased from 1 month to 1.5 months of salary.
Decree No. 338/2026/ND-CP takes effect from August 26, 2026.
The level of allowance benefits; the time and salary used as the basis for calculating allowance benefits specified in this Decree are applied to cases of sacrifice, death or early retirement, demobilization, transfer to another sector, resignation from September 1, 2026.
