The amendment to the Investment Law will shift from pre-inspection to post-inspection, reduce administrative procedures, and investors will not have to carry out certain procedures to obtain a license.

Continuing the 38th session, on the morning of October 10, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.

Presenting the Government's proposal, Minister of Planning and Investment Nguyen Chi Dung said that regarding the amendment of the Law on Planning, the amendment and supplement of regulations will simplify the planning process, avoid duplication and shorten the planning time.

At the same time, specific regulations are provided on the participation and synchronous coordination of relevant agencies in the process of planning and appraisal.

Amend and supplement the provisions in Article 45 in the direction of removing the provision that "land use plan" is a content of the planning implementation plan to avoid duplication with the land use plan established in accordance with the provisions of the law on land.

Regarding the amendment of the Investment Law, the amendment and supplement in Article 33 stipulates that for urban planning, the appraisal content must include an assessment of the suitability of the investment project with the zoning plan.

Supplementing the provisions in Clause 3, Article 18 of the Investment Law to regulate the establishment of an Investment Support Fund from the state budget and other legal sources of revenue to attract strategic investors, multinational corporations and support businesses in a number of investment incentive industries and professions.

Amend and supplement Articles 47 and 48 to regulate the termination of investment projects that have not been implemented for many years, causing waste of land and releasing resources.

Switch from pre-inspection to post-inspection, reducing related administrative procedures, in which investors do not have to carry out some procedures to obtain licenses, approvals or permits in 3 areas that require a lot of administrative time: construction, environmental protection and fire prevention and fighting (it is expected to reduce the time to carry out administrative procedures by up to 260 days).

Regarding the amendment to the Law on Bidding, Minister Nguyen Chi Dung said that this law allows the approval of contractor selection results before the project is approved or the signing of contracts with contractors before international treaties and foreign loan agreements are signed, in order to help save time and speed up the implementation of projects and bidding packages.

Supplementing bid packages that apply the form of contractor selection in special cases, and at the same time decentralizing the authority to decide on the application of this form to speed up the implementation progress of projects and bid packages with special requirements on contractor selection for which other forms of contractor selection prescribed in this law cannot be applied...

Amending regulations on applying direct procurement to the purchase of drugs for retail sale at drug retail establishments to remove difficulties in drug retail activities at hospital pharmacies, speed up drug procurement progress, and meet the quality and requirements for medical examination and treatment.

Amend regulations on contractor appointment and contractor planning basis to ensure consistency and consistency with laws on national planning and reserves.
