Amending the Law on Energy Saving to respond to green policies

Continuing the 9th Session, the National Assembly listened to the Submission and Report on the review of the draft Law amending and supplementing a number of articles of the Law on Energy Efficiency and Savings Use.

On the afternoon of May 5, continuing the 9th session, the National Assembly listened to the Submission and Report on the review of the draft Law amending and supplementing a number of articles of the Law on Energy Efficiency and Savings Use.

Presenting the draft Law to the National Assembly, Minister of Industry and Trade Nguyen Hong Dien said that after 15 years of implementing the Law on Energy Efficiency and Savings, the law has revealed some shortcomings.

The review to amend and supplement a number of articles in the law to respond to new challenges related to Green policies, such as carbon emissions tax (Emissions Trading System-TS), CBAM, carbon traces... from demanding export markets such as Europe, America and even ASEAN countries such as Thailand, Malaysia and Singapore are also developing regulations on taxes related to emission control.

In addition, in the context of complicated challenges in climate change, environmental degradation and the risk of not being achieved on time by 2030, the trend of strengthening greenhouse gas emission control is increasing globally, and environmental policies in European and US markets can be seen as technical environmental barriers of the markets.

The above regulations are increasingly dense, creating great pressure on Vietnam's main export industrial products such as textiles, footwear, plastic, steel, electricity, electronics for seafood processing... directly affecting Vietnam's direct labor force estimated at about 20/52 million direct workers (2023) and directly affecting Vietnam's GDP.

An important thing is that Vietnam has committed to bringing net emissions to 0 by 2050. Therefore, along with the drastic and reasonable conversion of energy sources to reduce fossil energy sources and increase renewable energy sources, Vietnam needs to consider amending the Law on the Use of Energy economy and Efficiency in the direction of strengthening mandatory regulations and sanctions instead of encouraging the implementation of energy-saving solutions.

"The amendment and supplementation of the Law will help Vietnam promptly utilize, attract and mobilize international resources to support and promote the process of energy-saving investment and market conversion of energy-saving products," Minister Nguyen Hong Dien stated.

Presenting the report of the Law on the Law on Amending and Supplementing a Number of Articles of the Law on Effective and Effective Energy use, Chairman of the National Assembly's Committee of Science, Technology and Environment said that the Law Dossier is prepared seriously and basically meeting the requirements as prescribed and eligible to submit to the National Assembly.

However, the National Assembly's Committee on Science, Technology and Environment recommends that the drafting agency continue to review, compare, and evaluate each content in the 4 groups of policies with the provisions of the draft Law to ensure consistency; the amended contents to meet the requirements of practical state management and international integration.

At the same time, continue to review and institutionalize more clearly some contents of mechanisms and policies to mobilize resources for technology transformation, green, sustainable industrial development and energy-saving and efficient use in the context of Vietnam's shortage of energy sources.

In addition, it is necessary to review regulations on energy labeling subjects, inspection plans for compliance with regulations on management of energy-using vehicles and equipment, etc.

Regarding the regulation on energy labeling for construction materials, the National Assembly's Committee on Science, Technology and Environment found that construction materials have a great impact, directly affecting the energy efficiency of works; many countries have policies to encourage the use of materials with high energy efficiency.

"To implement this policy, there needs to be a sufficient system of standards, with inspection infrastructure and appropriate communication and incentive policies. Therefore, it is recommended to review and study to clarify the feasibility of this regulation; review and supplement the subjects of labeling; review the articles and clauses for appropriate revisions, ensuring consistency and convenience for the consolidation of documents", Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy stated.
