Party leadership and rule of law
The article “Promoting Party spirit in building a socialist rule-of-law state in Vietnam” is receiving much public attention. Through studying the work, many researchers, experts and scholars have commented that this is a very profound article, reflecting the strategic vision and determination of the Communist Party of Vietnam in building and perfecting a socialist rule-of-law state in Vietnam.
Mr. Nguyen Tuc - Chairman of the Advisory Council on Culture - Society, Central Committee of the Vietnam Fatherland Front - shared that the article by General Secretary To Lam clearly stated that in order to realize the country's development goals in the era of the Vietnamese nation's rise, it is necessary to continue to innovate the Party's leadership and governance methods; promote the people's mastery and harmoniously handle the relationship between the Party's leadership, the State's management, the people's mastery and promote the position and role of each of these factors in the process of building and perfecting the socialist rule-of-law state of Vietnam. These are very profound contents raised by the General Secretary in the article.
Associate Professor Dr. Le Quoc Ly - former Vice President of the Ho Chi Minh National Academy of Politics - said that one of the notable and emphasized points in the article by General Secretary To Lam is the affirmation of the rule of law in the Socialist Republic of Vietnam. This is the basic principle of a rule of law State, where all State and social management activities must be regulated and supervised by law.
However, the special thing in the socialist rule of law system is that the law must be based on the foundation of the Party's guidelines, policies and strategies. General Secretary To Lam's article clearly stated that the law in the socialist rule of law state needs to be continuously improved to institutionalize the Party's guidelines and policies, promote democracy, be for the people, recognize, respect, ensure and protect human rights and civil rights.
Combining ethics and rule of law
According to Mr. Nguyen Tuc, mentioning the socialist rule of law state means mentioning the rule of law. Under the leadership of the Party, the State manages society by law. Therefore, each cadre and party member must promote their role as exemplary and take the lead in implementing and complying with the law. This further contributes to strengthening the people's trust. "The higher the position of the cadre, the more exemplary he or she must be," Mr. Tuc emphasized.
In the article, General Secretary To Lam also mentioned that in order to promote the effectiveness of State management activities for society by law in the Socialist Republic of Vietnam, it is necessary to strengthen two factors at the same time: Moral governance and legal governance. In which, the moral governance factor is the promotion of the advantages, strengths, position, and role of grassroots Party organizations, the pioneering and exemplary nature of Party members and cadres to lead the legal governance factor, which is the implementation of social management by law.
The Chairman of the Advisory Council on Culture and Society, Central Committee of the Vietnam Fatherland Front, said that moral governance and rule of law are two complementary concepts in State management. In which, moral governance is the promotion of the qualities and revolutionary ethics of each cadre and party member, especially the exemplary role and pioneering in law compliance. This is especially important in building trust and arousing the spirit of democracy and rule of law from the leadership team itself. Rule of law is the management of the State by law, where everyone, including leaders, must comply with legal regulations. Rule of law creates transparency, clarity and fairness in social management.
“The combination of virtue and rule of law is extremely important, because rule of law without virtue will become rigid. On the contrary, virtue without rule of law can lead to arbitrariness and lack of transparency. Therefore, in the state management system, the combination of virtue and rule of law will create a social management environment that is both disciplined, humane and respectful of human rights. These two factors, when closely coordinated, will create the combined strength of the political system,” Mr. Nguyen Tuc analyzed.
