Government Inspectorate concludes the long-standing complaint of Suoi Ngoc - Vua Ba Cooperative

The Government Inspectorate determined that the decision to compulsorily dissolve Suoi Ngoc - Vua Ba Cooperative (HTX) was not in accordance with legal regulations.

The Government Inspectorate has just issued Notice No. 3415/TB-TTCP Announcing the inspection conclusion of the complaint settlement of Suoi Ngoc - Vua Ba Cooperative, Yen Xuan commune, Hanoi City. Previously, at the announcement of the inspection decision on April 9, 2026, Deputy Inspector General of the Government Le Tien Dat emphasized that this is a complaint case that has existed for more than two decades, has gone through many resolutions and reviews at all levels but has not been completely resolved.

The content of the complaint relates to Decision No. 290/QD-UBND dated April 4, 2007 of Luong Son District People's Committee, Hoa Binh province (formerly) on the mandatory dissolution of the Cooperative.

Suoi Ngoc - Vua Ba Cooperative was established in 1999. During its operation, the cooperative was discovered by functional agencies to have some violations. In 2002, after receiving complaints and denunciations, Luong Son District People's Committee conducted an inspection and issued a decision to suspend the cooperative's production and business activities.

In 2003, Hoa Binh Provincial People's Committee canceled the decision to suspend and allowed the Cooperative to continue operating for 3 months to transform into a business. In 2005, the Provincial People's Committee assigned Luong Son District People's Committee to handle violations and implement the mandatory dissolution of the Cooperative.

Notably, in November 2005, Luong Son District People's Committee reported to Hoa Binh Provincial People's Committee that there was not enough legal basis to issue a decision to compulsorily dissolve the cooperative. However, in March 2007, Hoa Binh Provincial People's Committee continued to request the district to implement it. On April 4, 2007, Luong Son District People's Committee issued Decision No. 290/QD-UBND to compulsorily dissolve Suoi Ngoc - Vua Ba Cooperative.

Through inspection, the Government Inspectorate determined that the Luong Son District People's Committee based on the fact that the Cooperative did not convert into a business as required by the Hoa Binh Provincial People's Committee to issue a decision on mandatory dissolution was not in accordance with the provisions of Clause 2, Article 42 of the 2003 Cooperative Law.

The responsibility for this lies with the People's Committee of Hoa Binh province, the People's Committee of Luong Son district and relevant units, organizations, and individuals.

In addition, the Government Inspectorate concluded that the first complaint settlement by the Chairman of Luong Son District People's Committee was not objective and not in accordance with regulations. Regarding the second complaint settlement, the Government Inspectorate also determined that the Chairman of Hoa Binh Provincial People's Committee's upholding the decision to compulsorily dissolve the cooperative was not in accordance with the provisions of the 2003 Cooperative Law.

From the inspection results, the Government Inspector General proposed that the Prime Minister consider and direct the Phu Tho Provincial People's Committee and Hanoi City People's Committee to organize a review to clarify the nature, extent, causes and specific responsibilities of each relevant organization and individual through each period; based on the review results, if there are sufficient grounds and bases as prescribed, organize a review of responsibilities for strict handling according to legal regulations; the results of the inspection conclusions should be reported to the Government Inspectorate for synthesis and reporting to the Prime Minister.

The Government Inspectorate also proposed that the Prime Minister consider and direct the Chairman of Hanoi City People's Committee to issue a decision to abolish Decision No. 290/QD-UBND dated April 4, 2007 of Luong Son District People's Committee on the mandatory dissolution of Suoi Ngoc - Vua Ba Cooperative.
