Using public assets for business without approval
On March 26, the Government Inspectorate issued a Notice of Inspection Conclusion on preventing and combating waste in the management and use of houses and land facilities of agencies, organizations, and state-owned enterprises (SOEs) managed in Ninh Binh province.
The inspection period is from January 1, 2019 to July 1, 2025. During this period, state management, waste prevention and control in the management and use of houses and land facilities of agencies, organizations, and SOEs are carried out by the People's Committees of Ha Nam, Nam Dinh and Ninh Binh provinces (before the merger) according to the area of each province.
Notably, the Government Inspectorate pointed out that some units in Ninh Binh province before the merger used public assets for business purposes, for lease, joint venture, and association when there was no Project approved by competent authorities; had not prepared dossiers to request and report to agencies and competent persons to decide on exploitation of assets.
People's Committees of provinces before the merger are slow to implement or have not fully implemented the Plan for rearranging and handling house and land facilities that has been approved.
The implementation of some housing and land construction investment projects is still slow, not ensuring the approved progress; some projects have been completed but the Investor has not prepared finalization documents or prepared finalization documents for submission for approval late.
Through inspection and verification of the management and use of 25 houses and land facilities at 19 agencies and units, some shortcomings and limitations were found such as: 7 houses and land facilities have not carried out procedures to issue Certificates of Land Use Rights; 7 houses and land facilities do not have complete legal documents on the origin of houses and land due to lost records; 7 houses and land facilities have not fully declared, not publicly disclosed, reported according to regulations, are slow or have not determined the value of land use rights to be included in the value of unit assets; 1 house and land facility has not completed site clearance according to the recovered land area;
1 facility of houses and land not put into use and the unit temporarily assigned to manage and use has reported and proposed to return the land, but the Provincial People's Committee has not had an effective handling and use plan; 4 facilities of houses and land are used for improper purposes; 15 facilities of houses and land are left unused, not put into use for many years, with the risk of wasting land funds and housing funds; 1 facility of houses and land is still being encroached upon with an area of 4,096.7m2.
There must be measures to rectify and handle violations
Responsibility for the above-mentioned limitations, shortcomings, and violations belongs to collectives and individuals responsible for performing state management functions and tasks in the management and use of houses and land, and collectives and individuals responsible for directly managing and using houses and land, including:
The Provincial People's Committee, relevant leaders of the Provincial People's Committee (due to the inspection period), departments and branches providing advice, relevant collectives, units, and individuals under the Provincial People's Committee, relevant departments and branches; Project investors, agencies, organizations, and units directly managing and using houses and land; relevant units and individuals under agencies, organizations, and units directly managing and using houses and land; need to seriously learn from experience and must have measures to rectify, overcome, and handle violations in accordance with regulations" - the Conclusion Notice clearly stated.
The Government Inspectorate proposed that the Prime Minister direct the Ninh Binh Provincial People's Committee to request a review and clarification of the responsibilities of collectives and individuals who have violations in the management and use of houses and land such as: Using houses and land for business purposes, leasing, lending, joint ventures, and associates when there is no Project approved by competent authorities; allowing houses and land to be encroached upon, used for wrong purposes, with the risk of causing waste of land funds and house funds;
Based on the results of self-criticism, inspection, review and rectification and remedy, the Chairman of the Provincial People's Committee shall handle according to his authority or direct and propose competent agencies to handle violations in accordance with regulations, ensuring that there is no situation of taking advantage of the management and use of public houses and land facilities for personal gain or causing loss and waste of public property.
