On August 14, Deputy Prime Minister Nguyen Chi Dung chaired a meeting to review the contents of the draft laws that the Ministry of Science and Technology (KHCN) chaired to submit to the National Assembly at the 10th Session of the 15th National Assembly.
4 draft laws include: Law on Digital Transformation; Law on amending and supplementing a number of articles of the Law on Intellectual Property; Law on High Technology (amended) and Law on amending and supplementing a number of articles of the Law on Technology Transfer.
Speaking, Deputy Prime Minister Nguyen Chi Dung stated that this is an opportunity to better generalise, synthesize, and synchronize the legal system on science and technology.
"It is necessary to ensure the urgency and quality of draft laws," the Deputy Prime Minister emphasized, pointing out the main difficulties: The progress of implementation; at the same time, many laws are easily overlapped, and there can be conflicts and conflicts between regulations.
According to the Deputy Prime Minister, first of all, it is necessary to clearly identify the principles, ideas, and goals of law amendment; the causes, sources, supplements, and benefits must be assessed.
"There cannot be one regulation that exists in both laws. As much as it is impossible to let the provisions in this law conflict with the provisions in another law. Therefore, the review work must be implemented very carefully," the Deputy Prime Minister noted.
The Ministry of Science and Technology is responsible for researching and reviewing to fully implement the viewpoints, directions, policies and guidelines of the Politburo; continuing to carefully review the problems and bottlenecks in the fields in the past time, to propose appropriate and practical mechanisms and policies.
At the same time, analyze and evaluate current major trends in the world and refer to the successful experiences of other countries; organize seminars and conferences to listen to more opinions from domestic and foreign experts.
Government leaders suggested that in the field of intellectual property, it is necessary to promote the handling of backlogged records; ensure full implementation of international commitments to which Vietnam is a member; procedures for granting intellectual property rights...
Regarding high technology, approaches in management, development of high-tech activities, strategic technology in line with general development trends and enhancing national competitiveness; amending mechanisms and policies to create a transparent, stable and attractive legal corridor for investment, production and business activities in the fields of high technology and strategic technology.
The Deputy Prime Minister suggested promoting M&A, sales, and merging companies holding core technologies to cooperate in research, access value chains and immediately commercialize.
In technology transfer, it is necessary to carefully review preferential and support policies; shortcomings, problems, and inadequacies, on that basis, consider and propose appropriate preferential and support policies, ensure synchronization and suitability to continue perfecting preferential policies, supporting and promoting research, development, transfer, mastering strategic technology, high technology, advanced technology, green technology, and environmental friendliness.
Along with that is the implementation of maximum decentralization and delegation of authority; reducing and simplifying administrative procedures; ensuring effectiveness and efficiency in the implementation of the law; improving the effectiveness of state management of technology transfer activities.
