Ms. Nguyen Thi Hoai (Ca Mau) said that, according to her understanding of Decree No. 98/2023/ND-CP dated December 31, 2023 of the Government, at Point c, Clause 2, Article 58 stipulates: Collectives awarded Certificates of Merit at all levels will be awarded a Certificate, frame and accompanied by a bonus twice the bonus for individuals specified in Point e, Clause 1 of this Article.
At Point e Clause 1 Article 58 stipulates: Individuals awarded Certificates of Merit as prescribed in Points a, b, c and d Clause 1 Article 75 of the Law on Emulation and Commendation shall be awarded a Certificate, frame and accompanied by a bonus of 0.3 times the basic salary.
According to the Law on Emulation and Commendation, at Points a, b, c and d, Clause 1, Article 75, regulations on certificates of merit belonging to and directly under Ministries, departments, branches up to district level.
"So can the Chairman of the People's Committee at the commune level award a Certificate of Merit to a collective? If so, what is the reward level for the collective that receives the Certificate of Merit from the Chairman of the People's Committee at the commune level?" - Ms. Hoai wondered.
Regarding the reflection and recommendation of Ms. Nguyen Thi Hoai, the Ministry of Home Affairs said: At Point d Clause 1 Article 75 of the Law on Emulation and Commendation stipulates that Certificates of Merit include: Certificates of Merit of the Chairman of the People's Committee at the commune level.
Clause 3, Article 80 of the Law on Emulation and Commendation stipulates: The Chairman of the People's Committee at the commune level decides to award the title "Advanced Worker", certificate of merit and the title "Cultural Family".
Based on the above regulations, the Chairman of the People's Committee at the commune level has the authority to award Certificates of Merit to collectives and individuals.
Regarding the bonus for the Certificate of Merit of the Chairman of the People's Committee at the commune level awarded to the collective: At Point g, Clause 1, Article 58 of Decree No. 98/2023/ND-CP stipulates the bonus level for the Certificate of Merit of the Chairman of the People's Committee at the commune level awarded to the individual.
According to Point c, Clause 2, Article 58 of Decree No. 98/2023/ND-CP, collectives awarded Certificates of Merit at all levels will be awarded a Certificate, frame and a bonus twice the bonus for individuals specified in Point e, Clause 1 of this Article.
According to the provisions of Clause 4, Article 53 of Decree No. 98/2023/ND-CP on the principles of calculating bonuses: In the same form of reward, the same level of reward, the bonus level for the collective is higher than the bonus level for the individual.
Thus, the bonus for the Certificate of Merit of the Chairman of the People's Committee at the commune level awarded to a collective will be twice the bonus for the Certificate of Merit of the Chairman of the People's Committee at the commune level awarded to an individual, which is appropriate.
