The National Assembly has passed the Law on Mutual Legal Assistance in Civil Matters, consisting of 4 Chapters and 38 Articles. This Law takes effect from July 1, 2026.
This Law stipulates the principles, authority, order, and procedures for implementing judicial assistance in civil matters between Vietnam and foreign countries; responsibilities of Vietnamese state agencies in judicial assistance in civil matters.
At the same time, this Law applies to Vietnamese agencies, organizations, and individuals, foreign agencies, organizations, and individuals involved in civil judicial assistance between Vietnam and foreign countries.
The Law on Mutual Legal Assistance in Civil Matters also clearly stipulates the responsibilities of state agencies in mutual legal assistance in civil matters.
Accordingly, the Government unifies state management of judicial assistance in civil matters nationwide; annually reports to the National Assembly on judicial assistance in civil matters.
The Ministry of Justice is responsible to the Government for implementing state management of judicial assistance in civil matters, assisting the Government in preparing annual reports to submit to the National Assembly on judicial assistance in civil matters.
In addition, the Supreme People's Court, the Supreme People's Procuracy, Ministries, ministerial-level agencies, government-attached agencies and other relevant agencies, within the scope of their tasks and powers, are responsible for coordinating with the Ministry of Justice in implementing state management of judicial assistance in civil matters in accordance with the provisions of this Law.
The People's Procuracy shall supervise the observance of the law in mutual legal aid in civil matters according to the provisions of this Law, the Law on Organization of the People's Procuracy and other relevant laws.
State agencies performing judicial assistance tasks on civil matters within the scope of their duties and powers according to the provisions of this Law and other relevant legal regulations.
