Allowances for resistance fighters under 20 years of service

The Ministry of National Defense has just issued a unified document on the regime for soldiers participating in the resistance war against the US to save the country who have served in the army for less than 20 years.

On March 31, according to the Ministry of National Defense's Electronic Information Portal, the Ministry of National Defense issued a consolidated document No. 06/VBHN-BQP of the Joint Circular guiding the implementation of Decision No. 142/2008/QD-TTg dated October 27, 2008 of the Prime Minister on implementing the regime for soldiers participating in the resistance war against the US to save the country with less than 20 years of service in the army who have been demobilized or discharged to their hometowns.

Accordingly, the subjects of application are soldiers participating in the resistance war against the US to save the country, enlisted from April 30, 1975 onwards, have served in the army for less than 20 years and have been demobilized or discharged to their localities, and are not currently eligible for pension, disability allowance or monthly sick leave.

The Circular clearly states that those who are enjoying retirement benefits; those who betray or surrender to the enemy; violating discipline and being stripped of military title; illegally leaving the country; illegally leaving and staying abroad; having received a one-time subsidy... will not enjoy the regime.

According to the Ministry of National Defense, the calculation of the regime period is the actual working time in the army from the time of military service to the time of demobilization, discharge, and career change.

For example, the Ministry of National Defense said that those who have served in the army for 15 years to less than 20 years will receive a monthly subsidy, calculated based on the actual number of years of service.

The specific benefit level from January 1, 2009 to April 30, 2009, for people aged 15 to under 20 years, is from 690,000 VND/month to 828,000 VND/month.

From May 1, 2009 to April 30, 2010, the monthly allowance for people aged 15 to under 20 years ranges from VND 724,000/month to VND 869,000/month.

From May 1, 2010, the monthly allowance for people aged 15 to under 20 years is from 813,614 VND/month to 976,336 VND/month.

From May 1, 2011, onwards, the monthly allowance will be adjusted to increase by 13.7%, specifically those who have completed 15 years to under 20 years will receive allowances from 925,079 VND/month to 1,110,094 VND/month.

Regarding the one-time subsidy regime, the Ministry of National Defense said that for those who have actually worked in the army for 2 years or less, the one-time subsidy level is 2 million VND.

Those who have actually served in the army for more than 2 years, the third year or more, will receive an additional 600,000 VND per year.

The one-time subsidy level is calculated according to the following formula:

Benefit level = 2,000,000 VND + [number of years to be calculated for benefits - 2 years) x 600,000 VND].

According to the Ministry of National Defense, the monthly allowance payment is guaranteed by the central budget.

The records for those who are entitled to the regime include: Decision on demobilization, discharge, military background, extract 63; demobilization and discharge allowance book; demobilization and discharge allowance form; Party member's background (if any); confirmation letter from the old unit before the military is demobilized and discharged.
