The Ministry of National Defense has just issued Circular No. 25 guiding the implementation of a number of articles of Decree 21 on regimes and policies for officers who stop serving in the army; officers in active service who sacrificed or died; officers in active service who are transferred to professional soldiers or defense civil servants.
In particular, the agency issued a circular clearly stating the regime and policies for retired officers.
According to the circular, the age to determine the highest early retirement age for officers according to military ranks and to receive a one-time allowance must be at least 1 year (full 12 months) before the highest age limit as prescribed.
The military rank to determine the highest age limit is the military rank of an officer stated in the retirement decision (retirement preparation) of the competent authority.
In case an officer is allowed to retire early by competent authorities and wishes to retire immediately (not retire preparately) or retire preparately not for the prescribed time but still ensures 12 months before the age limit, he/she will receive a one-time subsidy.
However, if an officer is decided to receive a one-time allowance due to early retirement, he/she will not receive the difference between the salary of the last month before retirement and the pension of the first month, calculated for the number of months not yet retired in preparation for retirement.
If the officer's records only record the year of birth but do not have the date or month of birth, the date of July 1 of the year of birth will be used as the basis for calculating the retirement age.

The Circular also takes the case of Lieutenant Colonel Nguyen Van Ba, born in September 1974, enlisted in September 1992, holding the position of Head of the Department, working at the Political Department, Provincial Military Command.
According to current regulations, by the end of September 2028, Lieutenant Colonel Nguyen Van Ba will be 54 years old, the highest age limit according to the rank of lieutenant colonel. However, due to changes in the organization of the payroll, the army no longer needs to arrange for use.
This person is decided by competent authorities to retire early. The retirement preparation period is 12 months, from May 1, 2027 to April 30, 2028, receiving a monthly pension from May 1, 2028.
However, if Lieutenant Colonel Ba chooses to retire before the end of the prescribed period (end of April 2028), the highest early retirement period according to the rank of Lieutenant Colonel will only be 5 months (from May 2028 to September 2028). Therefore, this person is not eligible for a one-time allowance due to early retirement.
In case Lieutenant Colonel Nguyen Van Ba wishes to retire immediately (without retirement), receive a monthly pension from May 1, 2027 (52 years and 7 months), and is approved by the competent authority according to his wishes, this person will have a total early retirement period of the highest age according to the military rank of lieutenant colonel of 1 year and 5 months. In this case, Lieutenant Colonel Ba is eligible for a one-time allowance due to early retirement.
In addition, this person does not enjoy the difference between the last month's salary before enjoying the pension (April 2027) and the first month's pension (May 2027) for the number of months without preparing to retire (12 months), as prescribed by the Ministry of Defense.
