The Government has issued Decree No. 370/2025/ND-CP regulating Heads of Departments and Deputy Heads of Departments under People's Committees (PCCs) of communes, wards, and special zones of provinces and cities.
The Decree stipulates that the head of the department under the commune-level People's Committee (Department Head) appointed by the Chairman of the commune-level People's Committee is responsible before the commune-level People's Committee, the Chairman of the commune-level People's Committee and before the law for performing the functions, tasks, and powers of the department.
The deputy head of the department head under the commune-level People's Committee (Deputy Head of Department) is the person who helps the Head of Department direct some aspects of work and is responsible to the Head of Department for assigned tasks. When the Head of Department is absent, the Deputy Head of Department is authorized by the Head of Department to manage the activities of the department.
The number of Deputy Heads of Departments is calculated on the principle of an average of 2 deputy heads/room.
Based on the above regulations and the number of professional departments established, the commune-level People's Committee shall specifically decide the number of Deputy Heads of each professional department under management.
Decree No. 370/2025/ND-CP also amends and supplements Clause 1, Article 11 of Decree No. 150/2025/ND-CP stipulating the position and functions of commune-level professional departments.
According to new regulations, the department is a specialized agency under the commune-level People's Committee. The department has its own seal and account according to the provisions of law to perform assigned tasks; perform the function of advising and assisting the commune-level People's Committee in state management of industries and fields in the locality according to the provisions of law.
