Government finalizes increasing the number of professional departments under commune-level People's Committees

The Government stipulates that provincial-level People's Committees decide on the framework number of professional departments in commune-level administrative units, not exceeding the average of 4.5 organizations.

The Government has just issued Decree No. 370/2025/ND-CP regulating the organization of specialized agencies under the People's Committees of provinces and cities and the People's Committees of communes, wards, and special zones of provinces and cities.

Regarding the framework number of professional departments under the commune-level People's Committee, currently Decree No. 150/2025/ND-CP stipulates the framework number of professional departments under the commune-level People's Committee including 3 professional departments and public administration service centers.

However, in the process of operating the local government at 2 levels, there are many proposals and recommendations to increase the number of professional departments under the commune-level People's Committee to promptly resolve procedures and serve the essential needs of the people.

Therefore, Decree No. 370/2025/ND-CP has stipulated the increase in the number of professional departments under the commune-level People's Committee.

This increase is based on industry groups and fields specified in Article 15 of Decree 150/2025/ND-CP and criteria for classifying administrative units, population size, natural area, development level, socio-economic conditions, decentralization and delegation of power between local government levels and specific factors of each type of administrative unit.

Accordingly, the Provincial People's Committee decides on the framework of the number and names of professional departments applied at commune-level administrative units under management, ensuring that they do not exceed the average of 4.5 organizations (including: professional departments and Public Administration Service Centers) per commune-level administrative unit; Hanoi and Ho Chi Minh City alone ensure that they do not exceed the average of 4.7 organizations (including: professional departments and Public Administration Service Centers) per commune-level administrative unit.

The decision to establish professional departments is decided by the local government at the commune level.

In case commune-level administrative units do not establish professional departments, they shall arrange professional civil servants to advise and assist the commune-level People's Committee in state management of industries and fields according to regulations.

The Public Administration Service Center under the commune-level People's Committee shall implement the Government's regulations.

Decree No. 370/2025/ND-CP stipulates that commune-level People's Committees submit to the People's Council of the same level for decision on the establishment, reorganization, and dissolution of professional departments and other administrative organizations under commune-level People's Committees in accordance with the law.

Specifically stipulate the functions, tasks, and powers of specialized departments in accordance with the guidance of provincial-level People's Committees and ministries managing industries and fields; based on the number of specialized departments established and the average number of Deputy Heads of departments according to regulations, specifically decide the number of Deputy Heads of departments of each specialized department under management.

Authorize the implementation of one or more tasks and powers under the authority of the commune-level People's Committee in accordance with the law; annually, report to the commune-level People's Council (if any), and the provincial-level People's Committee on the organizational and operational situation of the professional department.

Decree No. 370/2025/ND-CP takes effect from January 1, 2026.
