The Government has just issued Decree No. 369/2025/ND-CP amending and supplementing a number of articles of Decree No. 36/2025/ND-CP dated February 25, 2025, stipulating the functions, tasks, powers and organizational structure of the Government Office.
Decree No. 369/2025/ND-CP removes the phrase "administrative procedure control" in Article 1 of Decree No. 36/2025/ND-CP. Thus, the Government Office no longer has the function of controlling administrative procedures.
Decree No. 369/2025/ND-CP also abolishes the tasks and powers on controlling administrative procedures specified in Clause 3, Article 2 of Decree No. 36/2025/ND-CP.
Decree No. 369/2025/ND-CP also amends and supplements Article 3 of Decree 36/2025/ND-CP on the organizational structure of the Government Office.
According to the new regulations, the organizational structure of the Government Office is reduced from 18 units to 17 units, including:
1. General Department.
2. Department of Law.
3. Department of General Economics.
4. Department of Industry.
5. Department of Agriculture.
6. Department of Science - Education - Culture of the commune.
7. Department of International Relations.
8. Department of Home Affairs.
9. Department of Public Service Organization.
10. Department of Monitoring Inspection Work (Department I).
11. Department of National Assembly, Local and Union Affairs.
12. Department of Secretariat - Editorial.
13. Department of Administration.
14. Department of Organization and Personnel.
15. Department of Digital Transformation.
16. Department of Management - Finance.
17. Government Electronic Information Portal.
Units under the organizational structure of the Government Office are administrative organizations whose functions, tasks, powers and organizational structure are regulated by the Minister or Chairman of the Government Office.
The Government Electronic Information Portal is allowed to use the national emblem seal.
The Administrative Department has 3 departments.
Ministers and Chairmen of Government Offices submit to the Prime Minister for promulgation a list of public non-business units directly under the Government Office.
Thus, compared to the old regulations, the organizational structure of the Government Office no longer has the Enterprise Innovation Department and the Administrative Procedure Control Department, and at the same time adds the Digital Transformation Department.
Decree No. 369/2025/ND-CP clearly states that the Enterprise Innovation Department shall perform its functions, tasks, and powers according to current regulations until the Minister, Chairman of the Government Office issues a Decision stipulating the functions, tasks, and powers of the General Economics Department.
The Department of Administrative Procedure Control (stipulated in Clause 16, Article 3 of Decree No. 36/2025/ND-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers and organizational structure of the Government Office) continues to perform the functions, tasks, and powers assigned according to current regulations until the competent authority issues a Decision stipulating the functions, tasks, powers and organizational structure of the Digital Transformation Department under the Government Office and the Department of Administrative Procedure Control under the Ministry of Justice takes effect.
Decree No. 369/2025/ND-CP takes effect from January 1, 2026.
