The Department of Home Affairs of Khanh Hoa province said that according to the guidance in Official Dispatch No. 962 dated June 14, 2025 of Military Region 5 (One document) on reviewing, selecting and arranging positions for the Military Command (CHQS) and the headquarters of the commune-level CHQS after the merger;
Accordingly, at the time of prior arrangement, the Commander of the Commune-level Military Command to ensure the criteria for participating in the Standing Committee of the Commune-level Party Committee must have a university degree (which can be applied to other specialized university degrees) and a political theory level from intermediate level or higher.
In Clause 1 of Guidance No. 4687 dated August 1, 2025 of the Ministry of National Defense on guiding the implementation of Criteria 19.1 in the set of criteria for new rural communes and advanced new rural communes for administrative units at commune level after arrangement, there are regulations on the professional qualifications of cadres of the Military Command at commune level as follows:
Commanders of the Commune-level Military Command are trained to have a university degree in basic military science and a high degree in political theory; Deputy Commanders and Assistants of the Commune-level Military Command are trained to have a college or university degree in basic military science (Regulation No. 57 of the Secretariat).
This Department wonders, for cases arranged according to the guidance in Official Dispatch No. 962 dated June 14, 2025 of Military Region 5 mentioned above with a university degree in another major, is it allowed to transfer salary to the specialist rank and is it considered to meet the standards for professional qualifications and political theory qualifications according to regulations?
At the same time, for cases of being arranged to hold positions of Commander of the Military Command, Deputy Commander, Assistant of the Commune-level Military Command with college and intermediate qualifications arranged before the time the Law amending and supplementing a number of articles of 11 Laws on Military and National Defense and Guidance No. 4687 dated August 1, 2025 of the Ministry of National Defense are promulgated, if there are changes in university and college training qualifications (in the right major), will salary be transferred to the corresponding rank or waiting for guidance documents from competent authorities.
Regarding the above content, the Ministry of Home Affairs has the following opinions: Regarding training standards for Commanders, Deputy Commanders, Assistants of the Commune-level Military Command, the Ministry of Home Affairs proposes that the Department of Home Affairs of Khanh Hoa province implement them according to the provisions of Article 26 of the 2019 Law on Militia and Self-Defense Forces (amended and supplemented in Clause 13, Article 10 of Law No. 98/2025); on standards for presenting political theory, implement them according to Regulation No. 57 dated February 8, 2022 of the Secretariat on subjects, standards and decentralization of political theory training.
The salary arrangement for Commanders, Deputy Commanders, and Assistants of the Commune-level Military Command when changing professional qualifications is proposed to be implemented according to the guidance in point c, clause 4, Official Dispatch No. 7644 dated September 9, 2025 of the Ministry of Home Affairs.
