In Official Dispatch 11185 sent to the Department of Home Affairs of Khanh Hoa province, the Ministry of Home Affairs has specifically guided the ranking of salaries into the rank of principal specialist for the Chairman of the Commune-level People's Committee.
Previously, the Department of Home Affairs of Khanh Hoa province said that based on point b, Clause 2, Article 70 of Decree No. 170/2025 dated June 30, 2025 of the Government stipulating the recruitment, use and management of civil servants, it is stipulated: Ranking officials or equivalents for cases of being appointed to positions, titles of Deputy Directors and equivalents under Ministries, ministerial-level agencies, agencies under the Government, organizations established by the Government, the Prime Minister but not public service units (applied to cases identified as civil servants and agencies, organizations assigned management authority); Deputy Directors of Departments and equivalents under provincial People's Committees; Chairmen of commune-level People's Committees.
The Department of Home Affairs of Khanh Hoa province wonders whether for cases of holding the position of Chairman of the People's Committee at the commune level who are receiving salaries in the specialist rank, is their salary transferred to the main specialist rank as prescribed above?
In case of being ranked, the Department requests the Ministry of Public Security to study and have specific guidance so that localities have a basis for synchronous implementation and implementation.
At the same time, for the case of holding the position of Chairman of the Commune-level People's Council (the same group as group 6 as the position of Chairman of the Commune-level People's Committee according to Regulation No. 368 dated September 8, 2025 of the Politburo) currently receiving salary in the specialist rank, is it allowed to transfer salary to the main specialist rank as the position of Chairman of the Commune-level People's Committee?
Regarding the above content, the Ministry of Home Affairs has the following opinions: Based on the Law on Cadres and Civil Servants and Clause 3, Article 71 of Decree No. 170/2025 dated June 30, 2025 of the Government stipulating: "Abolishing relevant regulations on commune-level civil servants in Decree No. 33/2023 dated June 10, 2023 of the Government stipulating cadres, commune-level civil servants and non-specialized personnel at the commune level, in villages and residential groups".
Accordingly, the salary ranking for commune-level civil servants is implemented uniformly according to the common salary regime applied to cadres and civil servants according to the Government's regulations.
Based on the provisions of point b, clause 2, Article 24 of the Law on Cadres and Civil Servants 2025 and point a and point b, clause 2, Article 70 of Decree No. 170/2025, the Ministry of Home Affairs requests the Department of Home Affairs of Khanh Hoa province to advise competent authorities to issue decisions to rank civil servants from specialists to chief specialists when they are appointed to positions and titles of Chairman of the People's Committee at the commune level and equivalent.
Decree No. 170/2025 does not stipulate the order, procedures, and dossiers for the above cases as before. Salary ranking is implemented according to the provisions of Circular 02/2017.
