Article 20 of Circular No. 40/2026/TT-BGDĐT of the Ministry of Education and Training regulating student affairs (effective from June 30, 2026) stipulates that violations are disciplined as follows:
1. Students with the following behaviors will be considered for disciplinary action:
a) Acts strictly prohibited in educational institutions specified in the Education Law;
b) Acts of violating the charter, internal regulations, rules, and rules of the school;
c) Law violations directly related to the educational environment, the legitimate rights and interests of learners, civil servants, employees and school activities.
2. The extent of the violation is determined as follows:
a) Level 1 is a violation of a nature, level of harm not large, impact within the scope of a class;
b) Level 2 is a violation of a large nature, extent, and harmfulness, affecting many classes and faculties of the school, causing bad public opinion in the school or outside the school;
c) Level 3 is a violation with very large nature, level, and harmfulness, scope of impact outside the school, causing public outrage in the collective of teachers, management officials, public employees, staff, and students of the educational institution, affecting the reputation of the school;
d) Level 4 is a violation of a particularly large nature, level, and harmful nature, with a scope of impact on the whole society, causing great public outrage among the collective of teachers, management officials, public employees, staff, and students of educational institutions, greatly affecting the reputation of the school.
Thus, from June 30, 2026, the student's violations for disciplinary consideration are classified according to the levels above.
