Clause 1, Clause 2, Clause 3, Clause 4, Article 33 of the Law on Road Traffic Order and Safety 2024 (effective from January 1, 2025) stipulates the driver, the person being transported, and the goods loaded on motorbikes and mopeds as follows:
1. Motorbike and motorbike drivers are only allowed to carry one person, except in the following cases, when they are allowed to carry a maximum of two people:
a) Transporting sick people to the emergency room;
b) Escorting people who have violated the law;
c) Children under 12 years old;
d) Elderly or disabled people.
2. Drivers and passengers on two-wheeled motorbikes, three-wheeled motorbikes, and mopeds must wear helmets that comply with national technical standards and fasten the straps properly.
3. Drivers of two-wheeled motorbikes, three-wheeled motorbikes, and mopeds are not allowed to perform the following acts:
a) Ride in a row;
b) Driving on the road reserved for pedestrians and other vehicles;
c) Use of umbrellas, audio equipment, except hearing aids;
d) Let go of both hands; ride on one wheel for motorbikes and two-wheeled motorbikes; ride on two wheels for motorbikes and three-wheeled motorbikes;
d) Using a vehicle to pull or push other vehicles or objects, leading livestock, carrying, shouldering and transporting bulky objects; carrying people standing on the vehicle, on the carrier or sitting on the steering wheel; loading goods on the vehicle beyond the prescribed limit;
e) Sitting on one side to drive the vehicle; standing or lying on the vehicle to drive the vehicle; changing drivers while the vehicle is running; turning the body to the back to drive the vehicle or driving blindfolded; using a kickstand or other object to scrape the road while the vehicle is running;
g) Other acts that cause disorder and disrupt road traffic safety.
Thus, from January 1, 2025, motorbike drivers are allowed to carry a maximum of two people in the above cases.
