Clause 4, Article 2, Circular No. 126/2026/TT-BCA of the Ministry of Public Security stipulating the order and procedures for implementing the content of expenditure from the Road Traffic Accident Damage Reduction Fund (effective from September 1, 2026) stipulates that support from the Fund should not be spent in the following cases:
a) Households, organizations, and individuals not falling into one of the cases specified in Article 11, Decree No. 279/2025/ND-CP;
b) Victims in road traffic accidents who are not processed, investigated, and resolved by competent authorities according to the provisions of law;
c) The person who caused the direct cause of the road traffic accident;
d) The victim is a vehicle operator participating in road traffic who: has alcohol concentration in the blood or breath; has drugs or other stimulants in the body that are prohibited by law; the vehicle does not meet the conditions for participating in road traffic according to the provisions of law;
e) Organizations and individuals with the function of providing emergency services, supporting patient transportation; medical examination and treatment facilities directly participating in helping, treating, and taking people in road traffic accidents to emergency care that collect emergency and transportation service fees;
e) Individuals who are performing tasks to ensure security, order, and road traffic safety and order directly participate in helping, rescuing, and taking road traffic accident victims to the emergency room.
Thus, the 6 cases mentioned above are not eligible for support from the Road Traffic Accident Damage Reduction Fund.
