The Lao Dong Newspaper Legal Consulting Office replied:
Clause 2, Article 4 of Decree 172/2025/ND-CP regulating disciplinary action against cadres and civil servants (effective from July 1, 2025) stipulates that in case of violations with one or more of the following circumstances, disciplinary action will be waived:
a) Confirmed by competent authorities on the status of civil act capacity loss when committing violations;
b) Must comply with the decision of the superior level as prescribed in Clause 5, Article 7 of the Law on Cadres and Civil Servants in 2025;
c) Confirmed by competent authorities in urgent situations, due to force majeure events or objective obstacles as prescribed by the Civil Code and the law on emergency situations when performing official duties;
d) Having complied with the regulations on authority, order, and procedures, not taking advantage during the performance of tasks but causing damage for objective reasons;
d) Implementing proposals on innovation and creativity permitted by competent authorities and determined by competent authorities to have implemented the policy correctly, with a clear driving force, for the common good but with damage.
e) Committing a violation to the extent of being disciplined but having passed away.
Thus, from July 1, 2025, the above cases of civil servants will be exempted from discipline.
