The Lao Dong Newspaper Legal Consulting Office replied:
Clause 6, Article 33 of Decree 33/2023/ND-CP stipulates: Part-time workers in villages and residential groups with no more than 3 positions (including Party Cell Secretary, Village Head or Residential Group Head, Head of the Front Working Committee) are entitled to monthly allowances. In case the Law has other provisions, it shall be implemented according to the provisions of that law.
Clause 2, Article 5 of Decree 154/2025/ND-CP regulating staff streamlining (effective from June 16, 2025) stipulates as follows:
The current monthly allowance for part-time workers at the commune level, in villages and residential groups is the allowance of the month immediately preceding the leave of absence, with the central budget allocating the allowance fund to pay.
In case a non-professional worker at the commune level, in a village or residential group concurrently performs the duties of another non-professional worker at the commune level, in a village or residential group, the current monthly allowance to be calculated as the monthly allowance of the current position and not the monthly allowance of the concurrent position.
Thus, the method of determining the allowance of the Village Chief to calculate the allowance for streamlining the payroll is regulated as above.
