The Lao Dong Newspaper Legal Consulting Office replied:
Article 47 of the Law on Social Insurance 2024 (effective from July 2025) stipulates the application for sickness benefits as follows:
1. The application for sickness allowance for employees or children of employees receiving inpatient treatment is the original or a copy of one of the following documents:
a) Discharge papers;
b) Summary of medical records;
c) Other documents proving the inpatient treatment process.
2. The application for sick leave benefits for employees or children of employees receiving outpatient treatment is one of the following documents:
a) Certificate of leave for social insurance;
b) The original or copy of the discharge paper with the indication of the time to be treated as an outpatient after the inpatient treatment period;
c) The original or a copy of the summary of the medical records with the indication of the time to be treated as an outpatient after the inpatient treatment period.
3. The application for sickness allowance for employees or children of employees receiving medical examination and treatment abroad is the medical examination and treatment documents showing the name of the disease and the duration of treatment issued by a medical examination and treatment facility abroad and must meet the following requirements:
a) Having a Vietnamese translation notarized or certified in accordance with the provisions of the law on notarization and certification;
b) getting consular status legal, except in cases where international treaties to which the Socialist Republic of Vietnam is a member have other provisions.
4. The Minister of Health shall prescribe the form, order, and authority to issue documents in the dossier specified in Clauses 1 and 2 of this Article issued by medical examination and treatment facilities and prescribe replacement documents in cases of force majeure due to natural disasters, catastrophes, and epidemics.
Thus, from July 1, 2025, the application for sickness allowance is regulated as above.
